Compliance requirements
The bidder must confirm that neither the bidder nor its administrative, management or supervisory board members or authorised representatives have been finally convicted within the last five years of participation in a criminal organisation, corruption, fraud, terrorism-related offences, money laundering or terrorist financing, or the illegal use of child labour or other forms of trafficking in human beings. The bidder must also have no outstanding tax or social security payment obligations, and awarding the contract must not breach an international or Estonian sanction. The bidder must confirm compliance with requirements concerning the employment of foreign nationals staying without a lawful basis. Where an exclusion ground applies, the bidder may in certain cases submit evidence of measures taken to restore its reliability. For tax and social security payments, the bidder must be able to provide evidence or information enabling the contracting authority to verify the situation from an official database.
Qualification criteria and exclusion grounds
The bidder must have properly completed at least one landscaping works contract during the 60 months preceding the start of the procurement. The required experience may be demonstrated through one or up to two contracts. The reference work must include the construction of planting areas, preparation of growing soil, planting of woody plants, at least 30 linear metres of hedge and at least 50 shrubs or other woody plants. For each reference work, the bidder must provide the contract title, the client’s name and contact details, the period of performance, a description and volume of the completed works, and confirmation that the works were properly performed. The bid must comply with all tender document requirements, and conditional bids are not permitted. The bid price must follow the prescribed structure and be itemised: for each plant species, the bidder must state the unit price, quantity and total price, together with separate prices for preparation and other works. Plant prices must be stated separately from planting, growing-soil, mulching and other works; the unit prices will also be used if plant quantities change.
