Compliance requirements

The bidder must confirm that neither the bidder nor its management, administrative or supervisory body members or representatives have been finally convicted during the last five years of participation in a criminal organisation, corruption, fraud, terrorism-related offences, money laundering or terrorist financing, or the use of child labour or other forms of human trafficking. The bidder must also have complied with its tax and social security payment obligations. The threshold for tax or social security debt is EUR 0; the tax authority does not issue a debt certificate where the debt is below EUR 100 or payment of the debt has been deferred. The exclusion grounds also cover bankruptcy, liquidation or insolvency proceedings, an agreement with creditors, suspended business activities, serious professional misconduct, anti-competitive agreements, conflicts of interest, involvement in preparing the procurement, serious breaches of previous public contracts, and the submission of false information or failure to provide required documents. Compliance with environmental, social and labour-law obligations is also checked. The bidder must additionally confirm that entering into the contract would not breach international or Estonian sanctions and that it has not enabled an unlawfully present foreign national to work in Estonia. The offered goods must not be subject to international sanctions or originate from a sanctioned region. The bidder may not involve subcontractors or suppliers representing more than 10% of the contract value where they are Russian citizens, residents or entities established in Russia, entities directly or indirectly more than 50% owned by such persons or entities, or representatives or instructed parties of such persons or entities. The bidder must also confirm that it will not involve a subcontractor subject to an exclusion ground and replacement under applicable law.

Qualification criteria and exclusion grounds

The bidder must have completed at least one sales contract for equivalent equipment during the 36 months preceding the initiation of the procurement. A mobile electric trommel screen is considered equivalent. The bidder must provide reference-contract information, including a description of the equipment or contract, the total amount and currency, the bidder’s area of responsibility, the performance period, and the contracting customer’s and contact person’s details, including contact information, in a form that allows the contracting authority to verify compliance. The bid must include the equipment’s technical description, the contracting authority’s completed technical description form and the required confirmations. The bidder must confirm that the bid complies with the tender documents, that the price has been submitted in the required structure and that any equivalence has been explained and evidenced. The bidder must be the manufacturer’s official representative in Estonia and hold the sales rights for the offered equipment. The bidder must have a workshop in Estonia capable of servicing the equipment when necessary, and that workshop must be officially authorised by the manufacturer to perform warranty work. For a joint bid, a power of attorney from the joint bidders must be submitted. The bidder must identify any trade secrets and justify their designation, or confirm that the bid contains no trade secrets; the bid price and numerical figures used for evaluation may not be designated as trade secrets.
