Tallinn, AJ786: ensuring compliance of feeder F9 in North Tallinn (IP9111)

The bidder will be excluded if the bidder, a member of its administrative, management or supervisory body, its procurist, or another person authorised to represent or control it or make decisions on its behalf has been convicted of participation in a criminal organisation, breach of an integrity obligation, corruption, fraud, terrorism or terrorist financing, money laundering, enabling the employment of a foreign national staying in the country unlawfully or violating that person’s employment conditions, unlawful use of child labour, or trafficking in human beings. Exclusion also applies where the bidder has unpaid state tax, payment or environmental-charge debt, or unpaid tax or social-security contributions in its country of establishment. The contracting authority may also exclude a bidder for a substantial or repeated breach of an earlier public contract where this resulted in withdrawal from or termination of the contract, a price reduction, compensation for damage or a contractual penalty. Exclusion may also result from providing false information about compliance with the qualification requirements or failing to submit required information or documents. The bidder must confirm that none of these exclusion grounds applies. Companies established or residing in the Russian Federation or Belarus may not participate. Materials, equipment, goods or components originating from or produced in those countries may not be used during performance of the works.

Within the 60 months preceding the start of the procurement, the bidder must have properly completed at least three contracts for electrical construction works similar to the subject of the tender. At least one contract must have had a value of at least EUR 40,000 excluding VAT. The bidder must submit a list of the contracts, including the performance period, the contracting party’s representative and contact details, and procurement reference numbers where applicable. The contracting authority may also request evidence of proper performance. The bidder must have an electrical works manager with a valid A competence certificate or a qualification of at least level 6 under the Estonian Professional Qualifications Act. The relevant proof must be valid when the tender is submitted, and the person must be registered in Elektrilevi’s partner portal before tenders are opened. The bidder must also have a person with the switching rights required for work on a 0.22–20 kV electricity network, registered in the same portal before tenders are opened. For work exclusively at 0.22–1 kV, at least low-voltage switching rights are required; in other cases, both low- and medium-voltage switching rights are required. The bidder must additionally have a person responsible for the work operation, registered in the partner portal before tenders are opened. The tender must comply with all tender-document requirements, be unconditional and include a fully completed price table with all unit-price fields. The bidder must provide the names, positions and contact details of the contract signatory or signatories and the procurement contact person, and submit a power of attorney where signing authority does not arise from the articles of association. The bidder must identify and justify any trade secret, or confirm that the tender contains no trade secret. Materials, equipment and components used for the works may not originate from or be produced in the Russian Federation or Belarus; the contracting authority may request certificates of origin.
