Compliance requirements

The bidder must confirm that neither the bidder nor its representatives or members of its administrative, management or supervisory bodies have been finally convicted during the last five years of participation in a criminal organisation, corruption, fraud, terrorism-related offences, money laundering or terrorist financing, unlawful use of child labour or other forms of human trafficking. This also covers cases where a disqualification imposed by a final judgment is still in force. Where applicable, the bidder must describe measures taken to restore its reliability and provide supporting information. Further exclusion grounds may include failure to pay taxes or social security contributions; breaches of environmental, social or labour-law obligations; bankruptcy, liquidation or other insolvency proceedings; an agreement with creditors; assets managed by a liquidator or court; suspended business activity; serious professional misconduct; agreements restricting competition; conflicts of interest; improper involvement in preparing the procurement; material breach or early termination of previous public contracts; and false information or failure to submit required documents. The bidder must also not have infringed rules concerning the employment of unlawfully staying foreign nationals, international or Estonian sanctions, or conviction for tax offences. For tax or social security debt, the notice specifies a threshold of EUR 0; under the stated rules, a tax-debt certificate is also not issued, among other cases, where the debt is below EUR 100 or payment has been deferred.

Qualification criteria and exclusion grounds

The bidder must appoint a project manager holding at least a level 6 road engineer qualification and submit the person’s CV. During the last five years, from September 2021 to September 2026, the project manager must have acted as project manager on at least two road or street reconstruction projects, each with a value of at least EUR 200,000 excluding VAT. This experience must be evidenced by a confirmation letter from the client stating the project name, procurement number if available, performance period, contract value and the project manager’s name. The bid must include Annex 2, consisting of the quantities table and tender form. The bidder must confirm acceptance of all conditions set out in the tender documents; conditional bids are not permitted. For crushed gravel position 6 used in the works, fraction 0/31.5, the bidder must submit a test report on grain-size distribution and fines content issued between September 2023 and September 2026 inclusive, together with the quarry production-control certificate and declaration of performance. For the gravel mixture, the percentage passing the 0.063 mm sieve must be greater than 8 and less than 11. A bid will be rejected if the gravel test report does not meet these requirements. The machine-readable notice did not specify a financial capacity or turnover requirement; any other requirements must be checked in the tender documents.
