The bidder must confirm that neither it nor its management, supervisory or authorised representatives have been finally convicted within the last five years, or remain subject to an exclusion period, for participation in a criminal organisation, corruption, fraud, terrorism-related offences, money laundering or terrorist financing, or the use of child labour and other forms of human trafficking. The bidder must also confirm that it has no outstanding tax or social security payment obligations, or that such obligations have been settled or covered by a binding payment arrangement. National exclusion grounds include enabling the employment of an unlawfully residing foreign national or paying below the legally required wage, and entering into the contract in breach of international or national sanctions. Where an exclusion ground exists, evidence of remedial measures restoring the bidder’s reliability may be submitted where legally permitted.

The bidder must be registered in the relevant business register of its country of establishment and provide the registration details or equivalent evidence. Within the 60 months preceding the start of the procurement, the bidder must have properly completed at least one construction contract involving the construction or reconstruction of a road, street, car park, paved area or another similar paved structure. At least one submitted contract must have had a value of at least EUR 40,000 excluding VAT. The bidder must provide a description of the work, its own responsibilities, the contract value and period, and the client’s and contact person’s details as evidence of the experience.
