Compliance requirements

The bidder must confirm that neither it nor its management, administrative or supervisory body members or other authorised representatives have been finally convicted during the last five years of participation in a criminal organisation, corruption, fraud, terrorist offences, money laundering or terrorist financing, or the illegal use of child labour or human trafficking. Compliance with tax and social security payment obligations is also checked. Grounds for exclusion may also arise where the bidder or its representatives have enabled an unlawfully staying foreign national to work or breached the conditions for employing a foreign national in Estonia, including by paying less than the statutory wage, or where awarding the contract would breach an international or Estonian sanction. The bidder must provide the required confirmations and, where necessary, supporting evidence. If an exclusion ground exists, the bidder may, where permitted, describe and prove measures taken to restore its reliability.

Qualification criteria and exclusion grounds

To demonstrate technical and professional capacity, the bidder must have completed at least two similar works corresponding to the subject of the tender during the 60 months preceding the start of the procurement. The bidder must provide descriptions of the works, their total value and period, its scope of responsibility, and the client and contact person details, together with any evidence that the works were properly completed. The tender must comply with all tender document requirements; conditional tenders are not permitted. The tender price must be submitted according to the prescribed pricing structure. If the bidder offers an equivalent solution instead of the specified requirement, it must explain the equivalence and provide supporting evidence. Joint bidders must appoint an authorised representative and submit an authorisation. The bidder must confirm that it will not use a subcontractor who is subject to mandatory replacement due to an exclusion ground. Any trade secret must be identified and justified separately in the tender; the tender price may not be classified as a trade secret.
