Compliance requirements

The bidder, or any member of its administrative, management or supervisory body, procurator, or person authorised to represent, decide for or control it, must not have been convicted of participation in a criminal organisation, breach of the duty of integrity, corruption, fraud, terrorism, money laundering or terrorist financing offences. Such persons must also not have been penalised for enabling an unlawfully resident foreign national to work or for breaching the conditions of a foreign national’s employment, including remuneration requirements, or for the unlawful use of child labour or an act related to human trafficking. The bidder must not have outstanding state tax, payment or environmental charge debts, or tax or social security contribution debts under the law of its country of establishment. Awarding the contract must not breach international sanctions or sanctions imposed by the Republic of Estonia. The bidder must submit a free-form confirmation that none of these grounds applies.

Qualification criteria and exclusion grounds

The bidder must demonstrate its ability to perform the contract in at least one of the following ways: by providing a bank statement confirming available funds of at least EUR 150,000, or by proving that, as at 30 June 2026, its equity amounted to at least 25% of the balance-sheet total and at least EUR 150,000. Under the second option, the bidder must submit an explanation of compliance and a balance sheet as at 30 June 2026 signed by its legal representative. The bid must include the contact details of the bidder’s authorised representative and the representative responsible for contract performance, namely the contractor’s project manager. Within the previous 120 months, the bidder must have acquired experience in constructing two pipes in one trench over a section of at least 100 metres beneath an asphalt-paved street. The gravity pipe must have had a diameter of at least De 315 mm and the pressure pipe a diameter of at least De 110 mm. The bid must identify the client of the previous work, the site location and the performance period, and include confirmation that the construction works were completed correctly and in accordance with good construction practice. The bidder may not rely solely on a subcontractor’s experience; if a subcontractor performs the works, that subcontractor must also have equivalent experience. In a joint bid, every joint bidder must have the required experience. The bidder must confirm that the bid complies with all tender document requirements; conditional bids are not permitted. The price form and the required free-form documents concerning financial capacity, representatives and pipeline construction experience must be submitted with the bid.
