Compliance requirements

A bidder must be excluded if the bidder or a relevant representative has been convicted of participation in a criminal organisation, corruption, fraud, terrorism-related offences, money laundering or terrorist financing, unlawful employment of foreign nationals, illegal child labour or trafficking in human beings. Exclusion also applies where the bidder has outstanding taxes, duties or social security contributions, or where awarding the contract would breach international or national sanctions. The contracting authority may exclude a bidder for breaches of environmental, social or labour obligations; bankruptcy, liquidation or comparable financial distress; serious professional misconduct; local tax arrears; anti-competitive agreements or coordinated practices; an unmanageable conflict of interest; an unfair competitive advantage arising from involvement in preparing the procurement; serious or persistent breaches of previous public contracts; false or misleading information; attempts to improperly influence the contracting authority or obtain confidential information; tax offences; or lack of the legal right to submit a tender. The bidder must provide the required exclusion-ground information. If the bidder relies on another entity’s resources, the required declaration concerning the absence of exclusion grounds must also be submitted for that entity.

Qualification criteria and exclusion grounds

The bidder must not have seriously breached administrative contracts or face circumstances that may lead to permanent insolvency or termination of business; these requirements also apply to all bidders in a joint tender, unless the bidder is a public-law entity. For lots 1–4, the bidder must have provided Estonian language teaching as part of formal education, or Estonian-language group training totalling at least 200 contact hours, during the period from 1 January 2023 until the date of publication of the contract notice. The bidder must submit the required qualification data and indicate whether it relies on another entity’s resources. The bidder must provide at least the minimum number of lecturers specified in section 2 of Annex 1. Lecturer names, copies of documents proving their education, the required evidence of completion of an Estonian language teaching course where applicable, and the lecturer information form in Annex 2 must be submitted. The A1-level curriculum must be prepared using the form in Annex 3 and must comply with the requirements in section 9 of Annex 1. Training must take place at the location specified for the relevant lot and within a maximum ten-minute walk of an official public transport stop. The training address must be included in the tender. The bidder must submit the required joint-tender authorisation where applicable, identify and justify any trade secrets, confirm compliance with the procurement documents and provide evidence of equivalence where necessary, and confirm that the tender and the service do not violate international or national sanctions.
