Compliance requirements
The bidder must confirm that neither it, its management or supervisory body members, nor persons authorised to represent or control it have been finally convicted within the last five years of, among other things, participation in a criminal organisation, corruption, fraud, terrorism-related offences, money laundering or terrorist financing, or the unlawful use of child labour or human trafficking. A continuing exclusion period imposed by a court may also constitute an exclusion ground. The bidder must not have breached its obligations to pay taxes or social security contributions; the notice specifies a EUR 100 threshold for tax debt and also addresses deferred obligations. Breaches related to enabling an unlawfully residing foreign national to work and violations of international sanctions are also covered. Where applicable, a bidder facing an exclusion ground may submit evidence of measures taken to restore its reliability. The bidder must provide the declarations required in the ESPD and, where necessary, supporting evidence.
Qualification criteria and exclusion grounds
The machine-readable notice and selected documents do not specify concrete turnover, prior experience, staffing or certification requirements. The bidder must provide the declarations required in the ESPD and submit a tender that complies with all procurement document requirements. Conditional tenders are not permitted. The tender price must be submitted according to the structure set out on the sheet for award criteria and rated indicators. The bidder must identify any trade secrets in the tender and explain the designation, or state that the tender contains no trade secrets; the tender price and other prohibited price-related indicators may not be classified as trade secrets. The bidder must confirm that the goods offered are not subject to international sanctions and do not originate from sanctioned regions, and that it will not use subcontractors or suppliers covered by the sanctions restrictions for more than 10% of the contract value. Any other detailed compliance and submission requirements must be checked in the tender documents.
