Compliance requirements

Bidders originating from third countries will be excluded from the procedure. A third country is a country that is not a Member State of the European Union or the European Economic Area, a party to the World Trade Organization Government Procurement Agreement, or a country with which the European Union has concluded a reciprocal free trade agreement covering public procurement. The bidder must state its country of origin, meaning the country in which the company is registered.

Qualification criteria and exclusion grounds

The bidder’s annual sales revenue must have been at least EUR 700,000 in each of the last three completed financial years ending before the start of the procurement procedure. The bidder must provide the sales revenue for all three required years; bidders established outside Estonia may be asked to submit signed financial statements or equivalent evidence. The tender must include a comprehensive price quotation, the technical requirements form in Annex 1, and the technical solution with specifications, drawings, diagrams and any other documents necessary to verify compliance. Conditional tenders are not permitted, and the tender must follow the structure specified in the procurement documents. Where an equivalent solution is offered, the bidder must explain the equivalence and provide supporting evidence. The warranty must last at least 24 months from commissioning and must apply without an additional service agreement. The bidder must respond to production-line malfunctions by remote assistance within one working day during working days from 08:00 to 17:00 Estonian time. If the problem cannot be diagnosed within 24 hours, an on-site technician must arrive within five working days. The bidder must submit a description of regular maintenance, the recommended maintenance frequency and the annual maintenance cost for three years, in euros excluding VAT. These maintenance costs must remain fixed for the three-year period and must not be included in the tender price. The bidder must also submit a declaration of compliance demonstrating compliance with the minimum requirements of Regulations (EC) No 1935/2004 and No 2023/2006 and Regulation (EU) No 10/2011, and specify the time and number of workers required to clean the production line. For a joint tender, an authorized representative must be appointed and a power of attorney submitted. The tender must remain valid for at least three months from the tender submission deadline, and the bidder must unconditionally accept the payment and contractual penalty provisions in the procurement documents.
