The bidder must confirm that it, its management or supervisory board members, representatives and persons with control powers have not been finally convicted within the previous five years of participation in a criminal organisation, corruption, fraud, terrorism-related offences, money laundering or terrorist financing, child labour or human trafficking. Where applicable, the bidder may describe measures taken to restore its reliability and provide supporting evidence. The bidder must not have outstanding tax or social security payment obligations. For tax or social security debt, the procurement passport specifies a threshold of EUR 0; the tax authority does not issue a debt certificate where the debt is below EUR 100 or where payment has been deferred. Additional exclusion grounds may include breaches of environmental, social or employment law, bankruptcy, liquidation or other insolvency proceedings, an arrangement with creditors, assets managed by a liquidator or court, suspended business activities, serious professional misconduct, anti-competitive agreements, conflicts of interest, serious breaches of previous public contracts, false information, failure to submit required documents, or improper attempts to influence the contracting authority’s decision-making. Compliance with international sanctions and rules concerning the employment of unlawfully staying foreign nationals is also checked. The bidder must confirm that it will not use a subcontractor during contract performance who would have to be replaced under the applicable legislation. First-tier subcontractors will be checked during contract performance; second- and subsequent-tier subcontractors will not be checked, and subcontractors are not required to submit a procurement passport.

The bidder must have completed at least two similar construction works as the main contractor during the 60 months preceding the publication of the contract notice. A similar work means the complete demolition of a building or buildings with a closed net floor area exceeding 1,000 m², including the demolition or reconstruction of external utility networks. The works must have been performed under concluded contracts and in accordance with good professional practice. The bidder must submit a list of completed contracts stating the closed net floor area of the buildings, contract dates, the client representative’s contact details and, for public contracts, the contract reference number. Evidence that the works were properly performed must be provided where required. The bidder, joint bidders and subcontractors directly involved in contract performance must have at least a level 6 qualification as a civil engineer or construction manager, specialising in building construction or general construction, with competences in construction management or the management of construction activities. The bidder must provide the competent person’s name, qualification and professional certificate number. At the contracting authority’s request, copies of professional certificates and education documents, together with the person’s consent to act as the responsible person for contract performance, must be submitted. A bidder established outside Estonia must provide evidence of an equivalent professional qualification. The tender must comply with the procurement documents; conditional tenders are not permitted. The price must be submitted in the prescribed structure and in the separate price table in Annex 2. Where relevant, equivalence must be explained and supporting evidence provided. In a joint tender, a power of attorney for the joint bidders must be included.
