Compliance requirements
The bidder, its management, administrative or supervisory body member, procurist or other authorised representative must not have been convicted of participation in a criminal organisation, breach of integrity obligations, corruption, fraud, terrorism, money laundering or terrorist financing offences. Such persons must also not have been convicted of enabling the employment of an unlawfully staying foreign national or breaching the conditions for employing a foreign national in Estonia, including paying less than the legally required remuneration, or of unlawful child labour or trafficking-related offences.
The bidder must not have outstanding national tax, payment or environmental charge debts, or unpaid tax or social security contributions under the law of its country of establishment. The contracting authority may also exclude a bidder for a substantial or repeated breach of an earlier public contract where this resulted, for example, in withdrawal from or termination of the contract, a price reduction, compensation for damage or a contractual penalty. Exclusion may also result from providing false information about compliance with the qualification requirements or failing to submit required information or documents.
An undertaking whose place of residence or establishment is in the Russian Federation or the Republic of Belarus may not participate.
Qualification criteria and exclusion grounds
The bidder must have properly completed at least three contracts for electrical construction works similar to the subject of the tender during the previous 60 months, including at least one contract worth at least EUR 35,000 excluding VAT. A list of the contracts must be submitted, showing the performance period, the contracting party’s representative and contact details, and, for public contracts, the reference numbers. The contracting authority may also request evidence of proper performance.
The bidder must have a person managing electrical works who holds valid A-level competence or a qualification of at least level 6 under the Estonian Professional Qualifications Act. The relevant evidence must be valid when the tender is submitted, and the person must be registered in Elektrilevi’s partner portal before tenders are opened. The bidder must also have a worker with the switching rights required for work in a 0.22–20 kV electricity network and a person appointed as responsible for the work operation; both must be registered in the partner portal before tenders are opened. For low-voltage works only, at least MP switching rights are required; in other cases, both MP and KP switching rights are required according to the work involved.
The tender must comply with all tender document requirements, and conditional tenders or tenders containing additional conditions are not permitted. The price must be submitted in the required table and all unit-price fields must be completed. The bidder must provide the details of the contract signatory and the contact person for contract performance, and submit a power of attorney where necessary. Any trade secret must be identified and justified; the tender price and numerical figures related to evaluation may not be classified as trade secrets. Materials, equipment or components originating from Russia or Belarus may not be used, and the contracting authority may request certificates of origin.
