Compliance requirements

The bidder, its management, administrative or supervisory body members, and persons authorised to represent, control or make decisions on behalf of the bidder must not have been finally convicted within the past five years of participation in a criminal organisation, corruption, fraud, terrorism-related offences, money laundering, terrorist financing, child labour or other forms of human trafficking, unless the applicable exclusion period has ended. If an exclusion ground applies, the bidder must provide the relevant information in the ESPD and, where applicable, describe the measures taken to restore its reliability. The bidder must not have outstanding taxes or social security contributions. The threshold for tax or payment arrears is EUR 0, although a tax arrears certificate is not issued in certain cases, including where the total debt administered by the same tax authority is below EUR 100 or payment has been deferred. The obligations must have been settled, or a binding agreement for payment must have been concluded, including for interest and late-payment charges. Exclusion may also apply where the bidder has enabled an unlawfully residing foreign national to work or breached the conditions for employing a foreign national in Estonia, including by paying below the required wage rate. The bidder must confirm that awarding the contract would not breach international or Estonian sanctions. The offered goods must not be subject to international sanctions or originate from a sanctioned region. The bidder must also confirm that its registered or permanent place of residence is not in the Russian Federation or Belarus.

Qualification criteria and exclusion grounds

The bidder must have completed at least one automatic fire alarm system construction reference during the 60 months preceding publication of the contract notice, with a value of at least EUR 60,000 excluding VAT. A client confirmation must be submitted confirming proper contract performance and providing information on the characteristics of the project. This confirmation is not required if the client was Tori Rural Municipality. For a contract concluded with Tori Rural Municipality, the procurement reference number must be provided. The design work must include at least one specialist holding the qualification “Security Systems Designer, level 6” or an equivalent qualification. The bidder must provide the specialist’s name, personal identification code and qualification or other details specifying the competence, together with supporting documents where necessary. The tender must comply with all procurement document requirements; conditional tenders are not permitted. The tender price must be submitted in the required structure using Form 1. Where applicable, equivalence must be explained and supporting evidence provided. For a joint tender, a power of attorney from the joint tenderers must be included. If the bidder relies on another entity’s resources, the prescribed consent form must be submitted. The bidder must also describe and justify any trade secrets, or confirm that the tender contains none, and provide details of authorised persons not visible in the commercial register or confirm that no such persons exist.
