Compliance requirements

The bidder, its management, administrative or supervisory board member, procurator, or any other person authorised to represent, control or make decisions for the bidder must not have been convicted of participation in a criminal organisation, breach of integrity obligations, corruption, fraud, terrorism-related offences, money laundering or terrorist financing. Grounds for exclusion also include convictions for enabling the employment of a foreign national staying in the country unlawfully or breaching the conditions for employing a foreign national in Estonia, including paying less than the required wage, as well as convictions relating to the unlawful use of child labour or human trafficking. The bidder must not have outstanding national tax, payment or environmental-charge debts, or tax or social-security contribution debts under the law of its country of establishment. The contracting authority may exclude a bidder that has seriously or repeatedly breached material terms of previous public contracts, or has submitted false information about compliance with the qualification requirements or failed to submit required information or documents. Companies established or resident in the Russian Federation or the Republic of Belarus may not participate.

Qualification criteria and exclusion grounds

During the 60 months preceding the start of the procurement, the bidder must have properly completed at least three contracts for electrical construction works similar to the subject matter of this contract. At least one contract must have a value of at least EUR 40,000 excluding VAT. The bidder must submit a list of the contracts including the performance period, the contracting authority representative’s contact details and, for public contracts, the reference numbers. The contracting authority may also request evidence of proper performance. The bidder must have a person managing the electrical works who holds a valid A-level competence or a qualification of at least level 6 under the Professional Qualifications Act, together with supporting evidence. This person must be registered in Elektrilevi’s partner portal before the tenders are opened. The bidder must also have an employee with switching rights for work-related switching operations in the 0.22–20 kV electricity network and a person designated as responsible for the work operation; both must be registered in the partner portal before the tenders are opened. For low-voltage-only works, at least low-voltage switching rights are required; in other cases, both low- and medium-voltage switching rights are required. The bid must include a fully completed price table with all unit-price fields filled in. The bidder must provide confirmation and details of the person authorised to sign the contract, as well as the contract performance contact person; a power of attorney must be added if the authority does not arise from the articles of association. The bidder must identify and justify any trade secrets in the bid or state that the bid contains none. The bidder must choose the contracting authority’s standard payment term or, if using the factoring programme, accept a 95-calendar-day payment term. Materials, equipment and goods originating from Russia or Belarus may not be used in the works, and the contracting authority may request certificates of origin.
