Compliance requirements

The bidder, its management, administrative or supervisory board member, procurist or other authorised representative must not have been convicted of participation in a criminal organisation, breach of the duty of integrity, corruption, fraud, terrorism-related offences, money laundering or terrorist financing. Such persons must also not have been convicted of unlawfully enabling a foreign national residing in the country without a legal basis to work, violating the conditions for a foreign national’s employment in Estonia, including paying less than the statutory wage, or using child labour unlawfully or committing a trafficking-related offence. The bidder must not have outstanding national tax, payment or environmental-charge debts, or tax or social-security contribution debts under the law of its country of establishment. The contracting authority may also exclude a bidder that has seriously or repeatedly breached material conditions of previous public contracts, or has submitted false information about compliance with the qualification requirements or failed to submit required information or documents. The bidder must confirm that it is not established or resident in the Russian Federation or Belarus and that the materials, equipment and goods used in the works do not originate from those countries.

Qualification criteria and exclusion grounds

During the 60 months preceding the start of the procurement, the bidder must have properly completed at least three contracts for electrical construction work similar to the subject matter of this contract. At least one contract must have had a value of at least EUR 40,000 excluding VAT. The bidder must submit a list of the contracts including the performance period, information about the other contracting parties, the contact details of the client’s representative and, for public contracts, the reference numbers. At the contracting authority’s request, the bidder must provide evidence of proper performance. The bidder must have a person responsible for managing the electrical works who holds a valid A-level competence or a qualification of at least level 6 under the Estonian Professional Qualifications Act. The relevant evidence must be available when the tender is submitted, and the person must be registered in Elektrilevi’s partner portal before the tenders are opened. For switching operations in the 0.22–20 kV electricity network related to the works, the bidder must have an employee with valid switching rights who is registered in Elektrilevi’s partner portal before the tenders are opened. For low-voltage works only, at least low-voltage switching rights are required; in other cases, both low- and medium-voltage switching rights are required. The bidder must also have a person responsible for the work operation, registered in the same portal before the tenders are opened. The tender must include a fully completed price table with all unit-price fields completed and must take account of the instructions for completing management-system document V178. The bidder must provide the details of the contract signatory, the basis of their representation authority and the contact person for contract performance; a power of attorney must be added where necessary. The bidder must identify any trade secrets and justify that classification, or state that the tender contains no trade secrets. Materials, equipment and goods used in the works, including components, may not be produced in or originate from the Russian Federation or Belarus; the contracting authority may request certificates of origin. The standard payment period is 14, 35 or 45 calendar days depending on the contract value, or 95 calendar days if the contracting authority’s factoring programme applies.
