Compliance requirements
The bidder, its management or supervisory board member, procurist, or any other person authorised to represent, direct or control it must not have been convicted of participation in a criminal organisation, breach of integrity obligations, corruption, fraud, terrorism, money laundering, terrorist financing, enabling the employment of an unlawfully residing foreign national, violating the employment conditions of a foreign national, including paying less than the required wage, unlawful use of child labour, or trafficking in human beings. The bidder must not have outstanding national tax, payment or environmental-charge debts, or tax or social-security contribution arrears under the law of its country of establishment.
The contracting authority may also exclude a bidder that has materially or repeatedly breached a previous public contract, or that has submitted false information concerning the selection criteria or failed to submit required information or documents. The bidder must confirm that none of the mandatory or discretionary exclusion grounds apply to it.
Qualification criteria and exclusion grounds
During the 60 months preceding the commencement of the procurement, the bidder must have properly completed at least three contracts for electrical construction works similar to the subject of this tender. At least one of those contracts must have had a value of at least EUR 40,000 excluding VAT. The bidder must submit a list of the contracts, including the performance period, information about the other contracting parties, the client’s contact details and, for public contracts, the relevant reference numbers. At the contracting authority’s request, the bidder must provide evidence of proper performance.
The bidder must have a person responsible for managing electrical works who holds a valid A-level competence or a qualification of at least level 6 under the Professional Qualifications Act, together with supporting evidence. This person must be registered in Elektrilevi’s partner portal before the bids are opened.
For switching operations in the 0.22–20 kV electricity network related to the works, the bidder must have an employee with valid switching authorisations who is registered in the partner portal before the bids are opened. For works limited to 0.22–1 kV, at least low-voltage switching authorisations are sufficient; in other cases, both low- and medium-voltage switching authorisations are required. The bidder must also have a person responsible for the work operation, registered in the partner portal before the bids are opened.
The bid must include a fully completed price table with all unit-price fields filled in and must take account of the contracting authority’s management-system instructions. The bidder must provide the names and contact details of the contract signatory and the contact person for contract performance, together with the basis for signing authority; a power of attorney must be added where necessary. The bidder must identify and justify any trade secrets in the bid, or state that the bid contains no trade secrets. The bid price and other figures characterising the bid for evaluation purposes may not be designated as trade secrets.
The bidder must take account of the contracting authority’s payment terms: 14 calendar days for a contract value up to EUR 59,999, 35 calendar days for a contract value of EUR 60,000–249,999, and 45 calendar days for a contract value of EUR 250,000 or more, calculated from receipt of the invoice. Under the factoring programme, the payment term is 95 calendar days.
