Compliance requirements

The bidder must confirm that neither the bidder nor any member of its administrative, management or supervisory body, procurator, or other person authorized to represent, control or make decisions for the bidder has been convicted of participation in a criminal organization, breach of the duty of integrity, corruption, fraud, terrorism, money laundering or terrorist financing. Such persons must also not have been sanctioned for enabling unlawful employment, violating the employment conditions of a foreign national, unlawful use of child labour or an act related to human trafficking. The bidder must not have outstanding state tax, payment or environmental charge debts, or tax or social security contribution debts. Awarding the contract must not breach an international sanction or a sanction imposed by the Government of the Republic. The bidder must confirm that none of these exclusion grounds applies. The bidder must notify the contracting authority of any known conflict of interest or competitive advantage, including where the bidder or a related person participated in preparing the procurement and obtained information unavailable to other bidders. If such circumstances exist, a free-form explanation must be submitted.

Qualification criteria and exclusion grounds

The bidder must be registered in the business register of its country of establishment where required by that country’s laws. Where applicable, proof of registration must be submitted; an Estonia-based bidder does not have to submit a copy of its register document. The bidder and/or subcontractor must have completed at least one similar contract involving the installation of evacuation lighting during the 60 months preceding the commencement of the procurement. The bidder must submit Form 2, the list of contracts, stating the contract value, dates and other contracting parties. If the bidder relies on a subcontractor’s experience or specialists, the subcontractor must be listed in the subcontractors table. The works must be supervised by at least one person responsible for electrical works who holds at least a B-class competence certificate, or equivalent or higher competence. Copies of documents proving the person’s qualifications and competence must be submitted. A foreign bidder without documents issued under Estonian regulations must provide qualification and competence documents issued in its country of establishment and confirm that it will submit confirmation issued by the Consumer Protection and Technical Regulatory Authority within one month after signing the contract. The bid must comply with the tender documents, be unconditional, and include the properly completed Form 1 bid form and the required pricing structure. Where necessary, equivalence must be explained and supporting evidence submitted. In a consortium bid, an authorization document for the consortium members must be included.
