Compliance requirements

The bidder must confirm that neither the company nor persons with management or representation powers have final convictions within the past five years for participation in a criminal organisation, corruption, fraud, terrorism, money laundering or terrorist financing, or illegal use of child labour or other forms of human trafficking. The bidder must also have no tax or social security payment arrears and must not have breached applicable environmental, social or labour law obligations. The exclusion grounds also cover bankruptcy, liquidation or other insolvency situations, agreements with creditors, assets administered by a liquidator or court, suspended business activity, serious professional misconduct, anti-competitive agreements, conflicts of interest, improper involvement in preparing the procurement, serious breaches of previous contracts, and the submission of false information or failure to provide required documents. National exclusion grounds are also checked, including allowing an unlawfully staying foreign national to work, international sanctions and convictions for tax offences. Where applicable, the bidder may submit evidence of remedial measures taken to restore its reliability.

Qualification criteria and exclusion grounds

Within the 60 months preceding the start of the procurement, the bidder must have replaced window or other building openings on at least one building. The work must have been completed properly. The bidder must provide a description of the reference project and details of the total value, its own scope of responsibility, the performance period, the client and the client's contact person; where applicable, information on an electronic source or supporting evidence must also be provided. The tender must comply with the procurement documents and must be unconditional. The required pricing form must be completed and submitted, and the tender price must follow the structure specified on the award criteria sheet. In a joint tender, a power of attorney for the joint bidders must be submitted. The bidder must identify and justify any trade secrets or confirm that the tender contains no trade secrets; the tender price and other prohibited indicators may not be classified as trade secrets. The bidder must confirm that it will not use a subcontractor subject to replacement under the applicable exclusion rules. Where relevant, equivalence must be explained and supporting documents provided. The goods offered must not be subject to international sanctions or originate from a sanctioned region.
