Compliance requirements

The bidder must confirm that neither it nor its representatives or members of its management or supervisory bodies have final convictions during the last five years for participation in a criminal organisation, corruption, fraud, terrorism, money laundering or terrorist financing, or the use of child labour or other forms of human trafficking. The bidder must also have complied with its obligations to pay taxes and social security contributions. The exclusion grounds also cover breaches of environmental, social and labour law obligations; bankruptcy; insolvency or liquidation proceedings; arrangements with creditors; other comparable insolvency situations; assets administered by a liquidator or court; suspended business activity; serious professional misconduct; agreements restricting competition; conflicts of interest; and inappropriate involvement in preparing the procurement. Grounds may also include a serious or repeated breach of a previous public contract resulting in termination, compensation or a contractual penalty, as well as false information, failure to provide required information or documents, or improper attempts to influence the contracting authority's decision-making. National grounds additionally concern enabling an unlawfully residing foreign national to work, compliance with international or Estonian sanctions, and convictions for tax offences. Where an exclusion ground exists, the bidder may, where permitted by the tender documents and applicable law, submit evidence of measures taken to restore its reliability. The bidder must provide the required declarations in the European Single Procurement Document and any additional evidence requested by the contracting authority.

Qualification criteria and exclusion grounds

The bidder must have properly completed at least 2 contracts for similar construction works during the 60 months preceding the commencement of the procurement. Similar works are construction and repair works on a hospital or another building connected with healthcare services. The European Single Procurement Document must include a list of the contracts with a short description, including the building's intended use, gross enclosed floor area, performance period, contracting authority and its contact details; procurement reference numbers must also be provided for public contracts. At the contracting authority's request, the bidder must provide evidence that the works were properly completed. The works must be carried out with a construction manager who holds a level 5 construction manager professional qualification or an equivalent qualification, has at least 5 years of construction experience, and has experience managing at least 2 similar projects in an operating hospital or another building providing healthcare services. The manager's CV must be submitted using the responsible specialist form. The tender must include a price breakdown table, and the tender price must follow the structure specified in the evaluation sheet. The bidder must confirm acceptance of the conditions in the tender documents; conditional tenders are not permitted. Where relevant, equivalence must be explained and evidence of equivalence submitted. In a joint tender, a power of attorney for the joint bidders must be included. The bidder must confirm that it will not use a subcontractor who would have to be replaced under the applicable law.
