Compliance requirements
The bidder will be excluded if the company, a member of its administrative, management or supervisory body, its procurator, or another person authorised to represent, control or make decisions on behalf of the company has been convicted of participation in a criminal organisation, corruption, fraud, terrorism or terrorist support, money laundering or terrorist financing, enabling the employment of an illegally residing foreign national or breaching the conditions for employing a foreign national in Estonia, unlawful use of child labour, or an offence related to human trafficking. Exclusion also applies where the bidder has outstanding national tax, payment or environmental-charge debts, or tax and social-security contribution debts under the law of its country of establishment. The contracting authority may also exclude a bidder for a serious or repeated material breach of a previous public contract where this resulted, for example, in withdrawal from or termination of the contract, a price reduction, compensation for damage or a contractual penalty, and for submitting false information or failing to submit required information or documents. The bidder must confirm that none of these exclusion grounds applies. Companies established or resident in the Russian Federation or the Republic of Belarus are not permitted to participate in the procurement as bidders. |
Qualification criteria and exclusion grounds
During the 60 months preceding the commencement of the procurement, the bidder must have properly completed at least three contracts for electrical construction works similar to the subject matter of the contract. At least one contract must have had a value of at least EUR 40,000 excluding VAT. The bidder must submit a list of the contracts including the performance period, the contracting authority representative’s contact details and, for public contracts, the reference numbers. At the contracting authority’s request, the bidder must provide evidence of proper performance, unless the contracting authority can obtain the information itself from public or private databases without significant expense. The bidder must have a person managing the electrical works who holds a valid A-level competence or a qualification of at least level 6 under the Vocational Qualifications Act, has the relevant proof valid at the time of tender submission, and is registered in Elektrilevi’s partner portal before tenders are opened. The bidder must also have an employee with valid switching rights for work-related switching operations in a 0.22–20 kV electricity network. For low-voltage works only, at least MP switching rights are required; in other cases, both MP and KP switching rights are required, including where low-voltage works require switching on the medium-voltage side. Applications for switching rights must follow document J387. In addition, the bidder must have a person responsible for the work operation, known as a C-person, registered in Elektrilevi’s partner portal before tenders are opened; the application of the relevant rights must follow documents J31 and J3284. The tender must include the completed pricing table with every unit-price field filled in, as well as the form containing information on previous contracts. The bidder must provide the details of the contract signatory and the contact person for contract performance; if signing authority does not arise from the articles of association, a power of attorney must be included. The tender must comply with all tender-document requirements, and conditional tenders or tenders containing additional conditions are not permitted.
