Compliance requirements
The bidder and its representatives must not be subject to exclusion grounds, including final convictions within the last five years, or an ongoing exclusion period, for participation in a criminal organisation, corruption, fraud, terrorism-related offences, money laundering or terrorist financing, unlawful use of child labour or human trafficking. The bidder must also not have breached applicable environmental, social or labour-law obligations, be bankrupt, in liquidation or otherwise insolvent, have committed serious professional misconduct, entered into competition-distorting agreements, have an unresolved conflict of interest, or have participated in preparing the procurement in a way that distorts competition. Exclusion may also result from a serious or repeated breach of previous public contracts, submission of false information, failure to provide required information or documents, or improper influence on the contracting authority’s decision-making. The threshold for tax and social security contribution arrears is EUR 0; the tax authority does not issue a certificate where the tax debt is below EUR 100 or payment has been deferred. The bidder must also confirm that the goods are not subject to international sanctions and that it has not enabled an unlawfully staying foreign national to work. First-tier subcontractors will be checked during contract performance and subcontractors must submit an ESPD. Where an exclusion ground exists, the bidder may provide information on remedial measures taken to restore its reliability where permitted by the applicable law and tender conditions.
Qualification criteria and exclusion grounds
The bidder must have at least three suitably qualified technical personnel: 1) a responsible person holding a Level 7 professional certificate as a chartered electrical engineer, an equivalent qualification, or an electrical-sector B-competence certificate; 2) a works manager holding a Level 4 professional certificate as a solar power system installer or a building electrician, an electrical-sector B-competence certificate, or an equivalent qualification; and 3) a construction-site manager holding a Level 4 professional certificate as a building electrician, an electrical-sector B-competence certificate, or an equivalent qualification. For each person, the ESPD must state the name, position, qualification and professional or competence certificate number. For qualifications issued abroad, the bidder must be ready to provide a copy of the certificate, and the qualification must be recognised in Estonia. Where the bidder relies on another entity’s specialist, that specialist must perform the qualification-dependent tasks during contract performance; a separate ESPD and the required confirmations must be provided for that entity. During the 60 months preceding publication of the contract notice, the bidder must have properly completed at least three construction contracts for the electrical installation of solar power plants, each with a construction capacity of at least 120 kW. The bidder must have performed these contracts itself and may not rely on another entity’s resources for this requirement. The bidder must provide the work title, description, address, client name and contact details, contract performance period, and confirmation from the other contracting party that the contract was properly completed. The tender must comply with the project, drawings and contract. The bidder must submit a technical description of the proposed solar panels, documents proving compliance with IEC/EN 61215 and IEC/EN 61730, manufacturer warranty documents, warranty terms, and lifetime maintenance plans for the solar panels and inverters. The solar panels must have at least a 25-year performance warranty and a 15-year product warranty, while the inverters must have at least a 10-year product warranty; confirmation of an authorised warranty representative in Estonia must also be provided. The price must be submitted using the Excel form in Annex 2 and the procurement register’s pricing form. Joint bidders must submit a power of attorney and confirmation of joint and several liability in accordance with Annex 4 Form I, together with the participation declaration in Annex 4 Form II. Visiting the contract performance site at L. Puusepa 8, Tartu, before 12:00 on 11 September 2026 is a prerequisite for submitting a tender.
