Compliance requirements

The bidder must confirm that the bidder itself, its management or supervisory board members, procurists, and other persons authorised to represent or control it have not been finally convicted during the last five years of participation in a criminal organisation, corruption, fraud, terrorist offences, money laundering or terrorist financing, or illegal use of child labour or human trafficking. Exclusion grounds may also include failure to pay taxes or social security contributions; breaches of environmental, social or labour-law obligations; bankruptcy; liquidation or other insolvency proceedings; an agreement with creditors; assets managed by a liquidator or court; suspended business activities; serious professional misconduct; anti-competitive agreements; a conflict of interest; or involvement in preparing the procurement in a way that creates an unjustified advantage. A bidder may also be excluded for a serious or repeated breach of a previous public contract resulting in early termination, damages or another sanction, as well as for submitting false information, withholding information, failing to provide required documents, or improperly influencing the contracting authority’s decision-making. The bidder must also confirm that the contract would not breach international or Estonian sanctions and that it will not use subcontractors or suppliers connected with Russian persons or entities for more than 10% of the contract value. A subcontractor subject to an exclusion ground may not be engaged either. Where an exclusion ground exists, remedial measures demonstrating restored reliability may be submitted in certain circumstances; the precise application must be checked in the tender documents.

Qualification criteria and exclusion grounds

The bidder’s average net turnover in the field related to the contract, calculated for the last three financial years completed before the start of the procurement (01/01/2023–31/12/2025), must be at least EUR 400,000. During the 36 months preceding the start of the procurement, the bidder must have properly completed at least two similar contracts. A similar contract is one concerning an office building, industrial or warehouse building, or educational or scientific building. At least one reference project must concern a food-processing building or a scientific or methodological institution building. The bidder must provide descriptions of the references, their values, performance periods, and the contracting authorities’ details and contact information. Throughout the contract period, the bidder must have liability insurance covering damage arising from the provision of cleaning services, including damage to third parties, for at least EUR 250,000 per incident. A copy of the document proving the existence of the insurance contract must be submitted after the contract is signed. The tender must comply with the tender documents, follow the required structure, and be unconditional. Where applicable, explanations and evidence of equivalence must be provided. All cleaning agents and consumable materials must carry the Nordic Swan Ecolabel or the EU Ecolabel. The bidder must complete cleaning monitoring sheets, follow special cleaning requirements, and apply HACCP and GMP principles in laboratories and food-processing areas. Specialists providing services to the contracting authority may not be citizens of, or reside or be established in, the Russian Federation or the Republic of Belarus. In a joint tender, a power of attorney for the joint tenderers must be submitted.
