Compliance requirements
The bidder must confirm that neither it nor its management, administrative or supervisory body members, procurators, or authorised representatives have received a final conviction within the last five years for participation in a criminal organisation, corruption, fraud, terrorist offences or terrorism-related offences, money laundering or terrorist financing, or the illegal use of child labour or human trafficking. The bidder must also have no outstanding tax or social security contribution debt. For tax debt, the notice states that the tax authority does not issue a debt certificate where the debt is below EUR 100 or payment has been deferred. In addition, the bidder must confirm that it has not breached requirements concerning the employment of illegally staying foreign nationals and that awarding the contract would not breach an international or Government of the Republic sanction. Where an exclusion ground exists, the bidder may submit evidence of measures restoring its reliability where legally permitted or provided for in the tender documents.
