Compliance requirements

A bidder will be excluded if the bidder, or a member of its administrative, management or supervisory body, a procurator, or another person authorised to represent, make decisions for or control the undertaking has been convicted of participation in a criminal organisation, breach of integrity obligations, corruption, fraud, terrorism-related offences, money laundering or terrorist financing. Exclusion also applies where such a person has been convicted of enabling the employment of an unlawfully residing foreign national or violating the conditions for employing a foreign national in Estonia, including paying below the required wage, or of unlawful use of child labour or trafficking in human beings. The bidder must not have outstanding state tax, payment or environmental charge debts, or tax or social security contribution debts under the laws of its country of establishment, and contract award must not breach an international or Government of Estonia sanction. The bidder must confirm that none of the exclusion grounds applies to it.

Qualification criteria and exclusion grounds

The bidder must be registered in the commercial register or an equivalent register in its country of establishment where registration is legally required. The contracting authority will verify data for Estonian bidders; a foreign bidder must submit a valid copy of its registration certificate. The bidder and/or its subcontractor must have completed at least one similar contract during the 60 months preceding the commencement of the tender. The contract must have involved demolition and crushing works for structures and soil removal works. A list of the main contracts must be submitted, including their value, dates and the details of the other contracting parties. The personnel responsible for the works must include a construction manager with a qualification in general building construction and a professional certificate for “Construction Engineer, level 6”, or an equivalent or higher qualification. A copy of the document proving the person’s qualification and competence must be submitted. If a foreign bidder does not hold qualification documents issued under Estonian regulations, it must submit copies of equivalent documents issued under the laws of its country of establishment and confirm that it will submit the certificate issued by the Estonian Consumer Protection and Technical Regulatory Authority within one month after signing the contract. The tender must comply with all tender document requirements and must be unconditional. The completed tender form and total tender price must be submitted. In a joint tender, an authorisation document for the joint tenderers must be included. If subcontractors are used, the bidder must submit the subcontractor’s consent and a completed subcontractor list showing all subcontractors, their registration codes and addresses, the work assigned to them and the percentage of the contract performed as subcontracting.
