Compliance requirements

A bidder must not be subject to the exclusion grounds under § 95(1), points 1–5 of the Estonian Public Procurement Act. These grounds include final convictions of the bidder or relevant representatives, managers, supervisory body members or authorised persons for participation in a criminal organisation, breach of professional integrity, corruption, fraud, terrorist offences, money laundering or terrorist financing; enabling unlawful employment or employment of a foreign national in breach of applicable conditions, including payment below the statutory wage rate; illegal employment of children or trafficking in human beings; outstanding state, tax or environmental-charge debts, or tax and social-security contribution debts under the law of the bidder's country; and circumstances where awarding the contract would breach an international or government sanction. The bidder must confirm that none of these exclusion grounds applies.

Qualification criteria and exclusion grounds

The bidder must be registered in the commercial register or an equivalent register in its country of establishment. A foreign bidder must submit a valid copy of the relevant registration certificate if registration is required under its national law. The bidder and/or its subcontractor must have completed at least one contract similar to the subject matter of this procurement during the five years preceding the start of the procurement. The relevant experience concerns interior finishing and renovation works and low-voltage and high-voltage electrical installations. The bidder must submit a list of the main contracts completed during the last five years, including their value, dates and other contracting parties, using the required contract list form, and confirm that the contracts were properly performed. The bidder and/or its subcontractor must provide qualified persons responsible for the works, including a person leading the construction works with a professional certificate as a construction engineer, level 6, or equivalent or higher qualification, and a person leading the electrical works with a professional certificate as an electrical engineer, level 6, with design rights, and/or a Class A competence certificate with design rights, or equivalent or higher qualification. Copies of documents proving the responsible persons' qualifications and competence must be submitted. Foreign bidders without documents issued under Estonian regulations must provide equivalent documents issued under the law of their country and undertake to submit confirmation issued by the Consumer Protection and Technical Regulatory Authority within one month after signing the contract. The tender must be unconditional and confirm acceptance of all requirements in the procurement notice and tender documents. The tender price must follow the prescribed structure and the cost calculation must also be submitted using the required calculation form. The bidder must disclose any circumstances that may create a conflict of interest or distort competition; if such circumstances exist, a free-form explanation identifying the relevant person, relationship and information obtained must be submitted with the tender or European Single Procurement Document.
