Compliance requirements
The bidder, its management or supervisory board members, procurist, or other persons with control or decision-making authority must not have been convicted of participation in a criminal organisation, corruption, fraud, terrorism, money laundering, terrorist financing, or related offences. There must also be no conviction for enabling the unlawful employment of a foreign national, violating a foreign national’s employment conditions, unlawful use of child labour, or human trafficking. The bidder must have no outstanding taxes, public charges, or environmental fees, and awarding the contract must not breach international or Estonian Government sanctions. The bidder must confirm that none of these exclusion grounds applies. Any potential conflict of interest or competitive advantage arising from involvement in the contracting authority’s activities or in preparing the procurement must also be disclosed, with an explanation of the relevant circumstances.
Qualification criteria and exclusion grounds
The bidder must be registered in the commercial register or an equivalent register in its country of establishment. The bidder and/or its subcontractor must have properly completed at least one similar contract during the 60 months preceding the start of the procurement. Similar work means designing, supplying, installing, integrating with existing control systems, and commissioning analysers or gas analysis systems used for measuring smoke, process, or other industrial gases in an industrial undertaking. The bidder must submit a list of contracts, including their value, dates, and the other contracting parties, together with confirmation that the work was properly completed.
The works must be carried out under the responsibility of qualified personnel. The designer of electrical and automation equipment must hold a level 6 electrical engineer qualification with design competence and/or an equivalent or higher class B competence certificate. The person managing the installation works must hold an equivalent or higher class B competence certificate. The bidder must submit a list of responsible persons and copies of documents proving their qualifications and competence. Where a foreign bidder does not hold documents issued under Estonian requirements, it must provide documents issued under the law of its country of establishment and undertake to obtain confirmation from the Estonian Consumer Protection and Technical Regulatory Authority within one month after signing the contract.
The tender must be unconditional and comply with all procurement documents. The price must be submitted in the prescribed structure and also in the required calculation form. The bidder must provide documents, a list, or product passports proving the types and technical characteristics of the proposed equipment and materials. Subcontracting is permitted, but the size and nature of the intended subcontracted part must be disclosed. The bidder must identify any trade secrets and justify that classification; the tender price and numerical figures relevant to evaluation may not be classified as trade secrets.
