Compliance requirements
A bidder will be excluded for tax arrears or overdue social security contributions under the laws of the bidder’s country of establishment. The contract must also not result in a breach of international sanctions. A bidder established outside Estonia must provide a certificate from the competent authority in its country confirming the absence of tax debts. The bidder must provide a free-form confirmation that neither the bidder nor any member of its administrative, management or supervisory body is subject to international sanctions. Participation is open to bidders established in Estonia, an EU or EEA Member State, or a country that has joined the WTO Government Procurement Agreement; the place of establishment must be evidenced by a commercial register extract, an authority certificate or another relevant document.
Qualification criteria and exclusion grounds
The bidder’s average annual net turnover for the last three completed financial years must be at least EUR 6,800,000. For a bidder operating for a shorter period, the completed financial years available will be considered. In a joint tender, it is sufficient for at least one joint tenderer to meet this requirement. During the 60 months preceding the tender deadline, the bidder must have successfully completed at least three contracts for CO₂ recovery and liquefaction plants. Each reference must involve CO₂ recovery from biogas or from an off-gas stream generated by upgrading biogas to biomethane, with a net liquid CO₂ production capacity of at least 500 kg per hour; at least one reference must concern food-grade CO₂ production. The plant must have been commissioned and accepted by the customer or entered commercial operation. References must be submitted using the required form, and the procurer may request additional explanations or documents within 5 working days where information is not otherwise available. The bidder must nominate a project manager with at least 5 years of relevant project-management experience and experience in at least one CO₂ recovery or liquefaction plant project. The key personnel must collectively cover CO₂ purification and liquefaction process design, feed-gas qualification and food-grade CO₂ quality, PED, ATEX, conformity assessment and electrical safety, and PLC/SCADA integration. One person may cover several areas if they have the required competence and sufficient capacity. The tender must include a price schedule and payment schedule, a technical proposal containing the process concept, preliminary mass and energy balance, process flow diagram, main equipment list, preliminary layout, principal technical and physical interfaces, and feed-gas treatment concept. For each material technical requirement, the technical proposal must identify the offered solution, value or method and refer to the relevant document section. The bidder must also submit the guaranteed performance and contractual penalties form and confirm compliance with the procurement documents; where an equivalent solution is offered, its justification and supporting evidence must be provided. A joint tender must include a power of attorney for the representative of the joint tenderers.
