Compliance requirements

The bidder must confirm that neither it nor its management, administrative or supervisory body members or representatives have received a final conviction during the last five years for, among other things, participation in a criminal organisation, corruption, fraud, terrorism-related offences, money laundering, terrorist financing or illegal use of child labour. The tender also checks payment of taxes and social security contributions, as well as bankruptcy, insolvency, liquidation, suspended business activity, serious professional misconduct, anti-competitive agreements, conflicts of interest and serious breaches of previous contracts. Exclusion may also apply because of false statements or failure to provide required information, improper influence on the contracting authority, offences involving unlawful employment, international sanctions or tax offences. Where permitted by applicable law or the tender documents, the bidder may submit evidence of measures taken to restore its reliability.

Qualification criteria and exclusion grounds

Within the 36 months preceding the start of the procurement, the bidder must have completed at least one contract worth at least EUR 80,000 excluding VAT. The contract must have covered the sale and installation of professional kitchen technology, such as refrigeration and freezer equipment, cooking equipment, stainless-steel kitchen furnishings or dishwashing equipment, including connection of the equipment. If a contract was still ongoing at the end of the reference period, only the part handed over to and accepted by the client is counted. For framework agreements, experience may be demonstrated through completed contracts or orders concluded under the framework agreement. The ESPD must include the contract description, value, contract and completion dates, and the client’s name and contact details; additional explanations or documents must be provided within five working days if requested by the contracting authority. The tender must include the price schedule in the required structure. The proposed equipment must comply with the technical specification, be compatible with the complete kitchen solution and the existing electrical, water and gas connections, and be ready for use at the installation site. For equivalent products, the bidder must submit the manufacturer’s technical data sheets or other evidence of equivalence. Measurable technical parameters may not be more than 10% worse than those of the sample products, except where fixed limits or requirements must be met in full. All equipment, connections, commissioning, operating and maintenance manuals, and conformity and warranty documents must be handed over within eight weeks of contract signature. Conditional tenders are not permitted. In a joint tender, a power of attorney for the joint bidders must be attached, and any claimed trade secret must be justified; the tender price may not be classified as a trade secret.
