Compliance requirements
The bidder must confirm that neither the company nor its representatives or controlling persons have been finally convicted within the relevant five-year period, or remain subject to an exclusion obligation, for participation in a criminal organisation, corruption, fraud, terrorist offences, money laundering or terrorist financing, or child labour and other forms of human trafficking. The exclusion grounds also cover tax and social security arrears, breaches of environmental, social or labour law, bankruptcy, insolvency or liquidation proceedings, arrangements with creditors, comparable national situations, assets managed by a liquidator or court, suspended business activities, serious professional misconduct, anti-competitive agreements, conflicts of interest, involvement in preparing the procurement, serious or repeated failures in previous public contracts, and false or misleading information or failure to submit required documents. National grounds additionally concern illegal employment of foreign nationals, international sanctions, certain local tax debts and convictions for tax offences. Tax and social security debts are assessed from a threshold of EUR 0; the notice explains that a tax debt certificate may not be issued where the debt is below EUR 100 or payment has been deferred. The bidder must provide the required confirmations and, where relevant, information and evidence. Where permitted, the bidder may explain remedial measures taken to restore reliability. First-tier subcontractors are checked during contract performance, but they are not required to submit a separate procurement passport. The bidder must also confirm compliance with the restriction on involving, for more than 10% of the contract value, subcontractors or suppliers connected to the Russian Federation as described in the tender documents.
Qualification criteria and exclusion grounds
For each lot, the bidder must have at least one year of continuous experience in providing cleaning services for the interior of educational, office and/or social buildings. At least one relevant contract must have been completed during the 36 months preceding the start of the procurement, with a total completed service value of at least EUR 100,000 excluding VAT. The bidder must submit the contract details, including value, dates and the other contracting party; for a public contract, the procurement reference number must also be provided. At least one completed work must be described. No separate financial turnover threshold is specified in the machine-readable qualification section. The bidder must have an implemented quality management system for monitoring and assuring the quality of indoor cleaning services and must submit a description of the measures used. Acceptable evidence may include an ISO 9001 certificate or equivalent, a quality management manual or another document proving implementation of the system. For each 30,500 square metres, the bidder must involve a foreman or site manager who directly organises and supervises service delivery. The person must hold at least a Level 4 Cleaning Services Supervisor qualification or a Level 5 Cleaning Operations Manager qualification, or an equivalent qualification. A bidder submitting an offer for three or all four lots must involve at least two persons with the required qualification. The bidder must provide each person’s name, personal identification code and relationship with the bidder, such as an employment or other civil-law contract. The bid must comply with all tender documents, conditional bids are not allowed, and the bidder must use the prescribed price submission structure and lot-specific offer form. The bidder must attend the contracting authority’s site visit and sign the attendance sheet. Environmental compliance requirements include staff training before service commencement on correct dilution and dosing of cleaning agents, wastewater disposal and waste separation, with evidence of the training. The bidder must provide lists and evidence for tissue products, hand soap and cleaning agents. Tissue products must comply with EN ISO 14024 Type I ecolabel requirements or an equivalent European standard; hand soap must meet the EU ecolabel criteria for rinse-off cosmetic products under Commission Decisions 2014/893/EU or 2021/1870; and cleaning agents must meet EU ecolabel criteria 1 and 4 for hard-surface cleaning products. Ecolabel certificates or equivalent conformity audits may be submitted. During contract performance, the bidder must monitor the quantities and dilution of cleaning agents, cleaning equipment and its reusability, water use and disposal, and solid waste and its separate collection at least once every four months. An ISO 14001-certified system, an EMAS-registered system or a relevant indoor cleaning services ecolabel may serve as an alternative for the monitoring procedure, subject to submission of the relevant certificate. The bidder must also provide the required declarations, joint-bid authorisation where applicable, confidentiality statement and equivalence evidence where an equivalent product, standard or certificate is offered.
