Compliance requirements
A bidder will be excluded if it has outstanding public tax, payment or environmental charge liabilities, or tax or social security contribution arrears under the law of its country of establishment. Rescheduled tax debt is permitted. For bidders established in Estonia, the contracting authority will verify the absence of tax arrears through the Estonian Tax and Customs Board; bidders established abroad must provide evidence of no tax arrears upon request.
Bidders originating from third countries will also be excluded. The bidder must state the country where it is registered and verify that its country of origin is eligible: a European Union or European Economic Area country, a party to the WTO Government Procurement Agreement, or a country with which the European Union has a reciprocal free trade agreement covering public procurement.
Qualification criteria and exclusion grounds
The bidder’s annual turnover in each of the last three financial years completed by the start of the procurement must be at least EUR 900,000. Turnover must be reported using the register form; a bidder established outside Estonia must be prepared to submit a copy of its annual report.
During the last 60 months, the bidder must have properly completed at least two building construction or extension works, each with a construction value of at least EUR 400,000. For each reference, the bidder must provide the client’s name and contact details, a brief description of the contract, the contract value, and the month and year when the works were accepted.
The tender must be unconditional and comply with the tender documents. The price must be submitted in the required structure together with Form 3, the bill of quantities. The bill of quantities must at least identify the building excavation, site excavation, site surfacing, subfloors, foundations, load-bearing and external walls, openings, roof structures, lifting and handling equipment, technical systems and general costs, as well as all other works required by the main design, with their prices.
The bidder must undertake to perform the works in accordance with the designs, include the required overhead crane in the tender, provide at least a four-year warranty for the construction works and at least a 24-month warranty for the crane. The scope includes applying for the occupancy permit and all other necessary permits, approvals and documents. Payments are made monthly on the basis of accepted work and invoices; no advance payment is made, and each instalment must have a payment term of at least 20 calendar days. For a joint tender, a power of attorney for the joint bidders must be submitted. Where necessary, explanations and evidence of equivalence must be provided.
