Compliance requirements
The bidder must confirm that none of the exclusion grounds under Section 95(1), points 1–3 and 5, of the Estonian Public Procurement Act apply. The bidder must not be bankrupt, in liquidation, subject to bankruptcy or liquidation proceedings, or in a comparable situation. The bidder must have no outstanding state taxes, public charges, environmental charges, tax debts or social security contribution debts. During the six-calendar-month reference period, the bidder’s employees’ average wage must have exceeded 70% of the average wage in the field corresponding to the subject matter of the contract. This must be evidenced by an extract from the Estonian Tax and Customs Board or, for a foreign bidder, by evidence from an equivalent competent authority. In a joint tender, each joint bidder must provide the wage evidence. The bidder must also confirm that it is not a related person to the technical consultant advising the beneficiary on the apartment building reconstruction. Exclusion grounds will be checked for the successful bidder and, in a joint tender, for all joint bidders.
Qualification criteria and exclusion grounds
The bidder must be registered in the economic activities register for construction activities covering general construction, indoor climate systems, and water supply or sewage systems inside or connected to a building. If electrical work is performed, the bidder must also be registered for construction and installation of electrical installations under electrical works. A foreign bidder may provide evidence of equivalent competence.
The bidder’s net turnover in the financial year preceding the start of the procurement procedure must be at least twice the estimated contract value excluding VAT; for a bidder using calendar years, the reference year is 2025. The bidder must be able to provide a 5% performance security no later than the contract signing date or within 10 calendar days after signing. An approved security from a credit or financial institution, or deposit of the corresponding amount into the beneficiary’s or a notary’s account, is acceptable.
Within the 60 months preceding the start of the procurement procedure, the bidder must have completed at least one equivalent construction project as the main contractor, with a value of at least half the estimated contract value excluding VAT. The project must have involved construction, extension or full-building reconstruction and must have included construction or reconstruction of load-bearing structures and external envelopes, heat-recovery mechanical ventilation, and a new heating system. The bidder must provide the project details, completion period and value, together with either the building register reference for the notice of use or occupancy permit, or a copy of a handover and acceptance certificate signed by the client and contractor.
The team must include a project manager, site manager, ventilation and heating systems specialist, water supply and sewage systems specialist, a person responsible for electrical works, and an authorised architect responsible for compliance of the building design with the requirements of the New European Bauhaus. The project manager must hold at least a level 6 civil engineering qualification specialising in building construction with competence in managing construction activities, or a level 6 construction manager qualification specialising in general construction. The site manager must hold at least a level 5 construction work manager qualification with comprehensive specialisation in general construction. The ventilation and heating specialist must hold the required level 6 qualification or equivalent competence, and the water supply and sewage specialist must hold at least the relevant level 6 qualification or equivalent competence. The person performing electrical work must hold at least a Class B competence certificate or a level 6 electrical engineering qualification for consumer electrical installations. The authorised architect must hold level 7 qualification. The name and professional or competence certificate number of each proposed person must be provided.
The bidder must have a quality management system for construction activities meeting ISO 9001 and an environmental management system meeting ISO 14001, or equivalent documentation. Certificates may be checked against the relevant database; if verification is not possible, the bidder must provide a valid certificate copy or other appropriate evidence upon request. The tender must be submitted using the contracting authority’s form, comply with all tender documents, and must not be conditional. In a joint tender, a power of attorney must specify the size and nature of the contract share performed by each joint bidder; joint bidders are jointly and severally liable. If an authorised representative submits the tender, evidence of that authority must be attached. Where equivalence is relied upon, it must be explained and supported by evidence. If persons who are not the bidder’s employees or registered competent persons are used to demonstrate team competence, written consent from each such person must be provided.
