Compliance requirements
A bidder will be excluded if the company, or a member of its administrative, management or supervisory body, a procurator, or another person authorised to represent or control it, has been convicted of participation in a criminal organisation, corruption, fraud, terrorism, money laundering, enabling illegal employment, breaching conditions for employing foreign nationals, illegal child labour, or human trafficking. Exclusion also applies where the bidder has outstanding state tax, duty or environmental charge debt, or tax and social security contribution debt under the law of its country of establishment. The contracting authority may also exclude a bidder for a serious or repeated breach of an earlier procurement contract, or for submitting false information or failing to provide required information or documents. The bidder must confirm that none of these exclusion grounds applies. Companies established or resident in Russia or Belarus may not participate. Materials, equipment, goods or components originating from or manufactured in Russia or Belarus may not be used in the works; the contracting authority may request certificates of origin.
Qualification criteria and exclusion grounds
During the 60 months preceding the start of the procurement, the bidder must have properly completed at least three contracts for electrical construction works similar to the subject matter of this tender. At least one of these contracts must have had a value of at least EUR 40,000 excluding VAT. The bidder must submit a list of contracts stating the performance period, information about the other contracting parties and the contracting authority’s representative’s contact details, including telephone number and email address; public procurement contracts must also include their reference number. Upon request, the bidder must provide evidence of proper performance, unless the contracting authority can obtain the information itself at no significant cost. The team must include a person with valid switching authorisations for work-related switching operations in the 0.22–20 kV electricity network. For low-voltage works only, at least low-voltage switching authorisation is required; in other cases, both low- and medium-voltage switching authorisations are required. This person must be registered in Elektrilevi’s partner portal before the tender submission deadline. The team must also include a designated person responsible for work operations, likewise registered in the partner portal before the deadline. In addition, the team must include a person leading the electrical works who has valid A-level competence or a qualification corresponding to at least level 6 under the Vocational Qualifications Act, the relevant evidence, and the required partner-portal registration. The tender must include a fully completed price table in the form specified in the tender documents; all unit-price fields must be completed. Conditional tenders or tenders containing additional conditions are not permitted. The bidder must provide the details of the contract signatory and the contact person for contract performance, and a power of attorney where necessary. The bidder must take account of the payment period: 14 calendar days for contracts up to EUR 59,999, 35 calendar days for contracts from EUR 60,000 to EUR 249,999, and 45 calendar days for contracts of EUR 250,000 or more; the payment period is 95 calendar days when the contracting authority’s factoring programme is used.
