Compliance requirements

The bidder must confirm that none of the exclusion grounds set out in § 95(1) and § 95(4) of the Estonian Public Procurement Act apply. The bidder must also confirm that it will not use a subcontractor who would have to be replaced under § 122(7) of the Act.

Qualification criteria and exclusion grounds

The bidder’s average annual sales revenue for the last three financial years completed by the start of the procurement (2023, 2024 and 2025) must be at least EUR 1,800,000. Revenue must be submitted using the register form; a company established outside Estonia must be prepared to provide a copy of its annual report. During the 60 calendar months preceding the start of the procurement, the bidder must have designed at working-project stage and constructed two similar or comparable buildings, each with a net floor area of at least 400 m². Suitable projects include healthcare, social-care and other public or publicly used buildings. The bidder must provide an overview of the previous contracts and the contact details of the clients. The contracting authority may request confirmation from a previous client that the contract was properly performed. If relying on another entity’s references, the bidder must submit that entity’s digitally signed consent and confirmation that it will participate in performing the contract. The team must include different individuals as construction project manager and site manager. The project manager must be at least a chartered construction engineer at level 7 or equivalent. The site manager must be at least a construction manager or construction engineer at level 6 or equivalent and must be permanently present at the construction site. The project manager must have participated as project manager in the performance of at least two similar building contracts involving completed buildings with a closed net floor area of at least 400 m². The site manager must have participated as site manager in at least one similar building contract. The projects must have been completed and handed over to the client. Signed CVs must be provided, and the contracting authority may request confirmation from a previous client. The team must also include specialists for indoor climate systems, high-voltage systems, low-voltage systems, and water supply and sewerage. Each must hold the relevant professional certificate and provide signed consent to participate in performing the contract. Where the bidder relies on another person’s or subcontractor’s experience or personnel, the required written consents must be submitted and their participation in the relevant contractual work must be ensured. The tender must be unconditional and comply with all tender documents. The bidder must submit a weekly work schedule reflecting the construction stages, the 9-month period for construction and any necessary design work, and the additional 2-month period for processing occupancy documentation. A fully completed bill of quantities must also be submitted; no line may be left blank or contain a value of “0”. The tender price must follow the prescribed structure. If an equivalent solution, standard, product or proof is offered, the bidder must explain the equivalence and provide supporting documents. The bidder must confirm that the goods offered are not subject to international sanctions and do not originate from sanctioned regions. The bidder must be able to provide a 10% performance guarantee and a 3% warranty-period guarantee, both calculated on the contract or completed-work value including VAT. By the start of contract performance, the successful bidder must provide the names, contact details and legal-representative information of known subcontractors.
