Compliance requirements

The bidder, its management or supervisory board member, procurator or another person authorised to represent or control it must not have been convicted of participation in a criminal organisation, corruption, fraud, terrorism, money laundering, enabling illegal employment, breaching the employment conditions of a foreign national, illegal use of child labour or an offence connected with human trafficking. The bidder must not have outstanding tax, payment, environmental charge or social security contribution debts, and awarding the contract must not breach international or Estonian sanctions. The contracting authority may also exclude a bidder that has materially or repeatedly breached a previous public contract, or that has provided false information about compliance with the qualification requirements or failed to submit required information or documents. The bidder must confirm that no exclusion grounds apply to it. Entities whose place of residence or registered office is in the Russian Federation or the Republic of Belarus may not participate. Materials, equipment, goods or components produced in or originating from those countries may not be used in the works; the contracting authority may request certificates of origin as evidence.

Qualification criteria and exclusion grounds

The bidder’s net turnover must have been at least EUR 200,000 in each of the last three completed financial years. The bidder must provide extracts from the annual reports for those three years, unless the information for an Estonian-registered legal person is publicly available to the contracting authority through a register. At least six months must have elapsed since the end of the last completed financial year by the tender submission date. During the 60 months preceding the commencement of the procurement, the bidder must have properly completed at least three contracts for electrical construction works similar to the subject matter of this contract. At least one contract must have had a value of at least EUR 80,000 excluding VAT. The bidder must submit a list of the contracts, including the performance period, information on the other contracting parties, the client representative’s contact details and, for public contracts, the reference numbers. Evidence of proper performance must be submitted upon request unless the contracting authority can obtain it from public or private databases without significant expense. The bidder must have a person leading the electrical works who holds valid A-level competence or a qualification of at least level 6 under the Estonian Professional Qualifications Act. The person must hold the relevant evidence at the time of tender submission and be registered in Elektrilevi’s partner portal before tenders are opened. The bidder must also have a person with the switching rights required for work on a 0.22–20 kV electricity network, registered in the same portal before tenders are opened. For work limited to 0.22–1 kV, at least low-voltage switching rights are required; in other cases, both low- and medium-voltage switching rights are required. In addition, the bidder must have a person responsible for the work operation, registered in the partner portal before tenders are opened. The tender must comply with all procurement documents; conditional tenders or tenders containing additional conditions are not permitted. The bidder must submit a properly completed price table with all unit-price fields filled in and include approximately 70 m² of landscaping restoration in the price. The names and contact details of the contract signatory and contract-performance contact person must be provided, together with a power of attorney where necessary. Previous contract information must be submitted using the contracting authority’s prescribed form.
