Compliance requirements
The tenderer must confirm that neither the tenderer, its management or supervisory board members, procurists, nor persons authorised to represent or control it have received a final conviction within the last five years for, among other matters, participation in a criminal organisation, corruption, fraud, terrorism-related offences, money laundering or terrorist financing, or the use of child labour or other forms of human trafficking. Exclusion may also result from breaches of tax or social security payment obligations, enabling an unlawfully residing foreign national to work, or a situation in which awarding the contract would breach an international or Estonian sanction. The tenderer must provide the confirmations and, where required, information and evidence requested in the ESPD. Where an exclusion ground applies, the tenderer may provide information on measures taken to restore its reliability to the extent applicable.
Qualification criteria and exclusion grounds
The tenderer, consortium members and subcontractors directly involved in contract performance must have the professional competence required for the construction works. At least one construction works manager with level 5 qualification is required. The tender must include the competent person’s name, professional qualification and professional certificate number; upon request, the contracting authority may also require that person’s written consent to participate in the works covered by the tender. As of the tender publication date, the tenderer must have completed at least one work similar to the subject matter within the previous 60 months in the field of surface restoration, and the work must have been approved and/or accepted as compliant. At least one similar contract must be listed, including the work description, value, contract dates, information about the other contracting party and the required reference or link; for a public contract, the notice or reference number must also be provided. The tender must comply with all tender documents, and conditional tenders are not permitted. The price must be submitted in the prescribed structure and using the separate price table in Annex 2. Where an equivalent solution is offered, its equivalence must be explained and supporting evidence provided.
