Compliance requirements
Mandatory exclusion grounds include final convictions of the bidder or relevant representatives for participation in a criminal organisation, corruption, fraud, terrorism-related offences, money laundering or terrorist financing; enabling unlawful employment or breaches of foreign workers’ employment conditions; unlawful child labour or trafficking; outstanding tax, payment or environmental-charge debts; and being subject to international sanctions where contract award would breach those sanctions.
The contracting authority may also exclude a bidder for breaches of environmental, social or labour-law obligations; insolvency, liquidation or suspended business activity; serious professional misconduct; anti-competitive agreements or coordinated conduct; an unavoidable conflict of interest; involvement in preparing the procurement that creates an unavoidable competitive advantage; serious or repeated breaches of previous public contracts; false or misleading information or failure to submit requested documents; tax-related convictions; or lack of the legal right to submit a tender. The bidder must confirm that none of the mandatory or voluntary exclusion grounds apply.
Qualification criteria and exclusion grounds
The bidder’s net turnover must have been at least EUR 300,000 in each of the last three completed financial years. The bidder must provide extracts from the annual accounts for those years showing the net turnover, unless the information is publicly available to the contracting authority from a register. At least six months must have elapsed since the end of the latest completed financial year by the tender submission date.
During the 60 months preceding the commencement of the procurement, the bidder must have properly completed at least three contracts for electrical construction works similar to the subject matter of the procurement. At least one of these contracts must have had a value of at least EUR 80,000 excluding VAT. A list of the contracts must be submitted, including the performance period, the contracting parties’ details and the contracting authority’s contact information, as well as reference numbers for public contracts. Evidence of proper performance must be submitted upon request unless the contracting authority can obtain it from public or private databases without significant expense.
The bidder must have a person with valid switching rights for work-related switching operations in the 0.22–20 kV electricity network, registered in Elektrilevi’s partner portal before the tenders are opened. For low-voltage works only, at least low-voltage switching rights are required; in other cases, both low- and medium-voltage switching rights are required where applicable. The bidder must also have a person responsible for the work operation, registered in the partner portal before the tenders are opened.
The bidder must have a person managing electrical works who holds valid A competence and/or a qualification of at least level 6 under the Professional Qualifications Act, with the relevant certificate and registration in the partner portal before the tenders are opened. The bidder must submit the required information on the contract signatory, their authority to represent the bidder and the contract-performance contact person; a power of attorney must be added if the authority does not arise from the articles of association.
The tender must include the completed pricing table in the required format, with all unit-price fields filled in. Conditional tenders or tenders containing additional conditions are not permitted. Joint bidders must appoint an authorised representative and submit the relevant power of attorney. The bidder must confirm that the materials, equipment and goods used, including components, are not manufactured in or originating from Russia or Belarus; certificates of origin may be requested.
