Compliance requirements
The tenderer must confirm that neither it nor its management, supervisory or authorised representatives have received a final conviction within the last five years for participation in a criminal organisation, corruption, fraud, terrorist offences, money laundering or terrorist financing, or illegal child labour or trafficking in human beings. The exclusion grounds also cover unpaid taxes or social security contributions, bankruptcy or another insolvency situation, liquidation, suspended business activity, serious professional misconduct, anti-competitive agreements, conflicts of interest, an improper advantage arising from involvement in preparing the procurement, material breaches of previous public contracts, and the submission of false information or failure to provide required documents. The tenderer must also confirm compliance with requirements concerning the employment of unlawfully staying foreign nationals, the absence of applicable international or national sanctions and the absence of convictions for tax offences. Where an exclusion ground applies, evidence of remedial measures may be submitted in certain cases; the availability of this possibility must be verified in the tender documents.
Qualification criteria and exclusion grounds
The tenderer’s average net turnover for the last three financial years (01/01/2023–31/12/2025) must be at least EUR 50,000 in each year. The contracting authority will check the information in public databases and may request extracts from the accounts for the three most recently completed financial years or other evidence of turnover.
During the last three years, the tenderer must have properly completed at least two contracts involving repair, maintenance, installation, demolition, site-maintenance or landscaping works for public-space structures or small structures. The completed contracts must demonstrate experience in the following work types: repair, installation, relocation or removal of structures or small structures; minor construction or demolition works; waste collection and removal or elimination of waste piles; and restoration of landscaping. The tenderer must provide descriptions of the contracts, their values, periods, client details and the tenderer’s area of responsibility.
For contract performance, the tenderer must have at least one foreman with at least three years of experience managing construction, site-maintenance, landscaping or structure-maintenance works and Estonian language skills at a level sufficient for communication. The foreman’s name, position, qualifications and experience must be provided.
The tender must comply with the tender documents and conditional tenders are not permitted. Prices must be submitted in the required structure in euros excluding VAT, to two decimal places. All lines in Annex 2 must be completed without alterations; the total price must also be entered in the procurement register, and in case of discrepancy the total price in Annex 2 will prevail. Unit prices may not be zero or negative, and must include all costs necessary for proper contract performance. If subcontractors are used, information about each subcontractor, the nature of the work or service and its percentage share must be submitted. A EUR 100,000 liability insurance policy must be provided for contract signing. In a joint tender, a power of attorney must be included. Any trade secrets and the reasons for their classification must be identified; the tender price may not be classified as a trade secret.
