Compliance requirements

The bidder must not be subject to any exclusion grounds. The ESPD must confirm that neither the bidder nor persons with management, representation or control powers have received a final conviction within the last five years for, among other matters, participation in a criminal organisation, corruption, fraud, terrorism-related offences, money laundering or terrorist financing, or illegal child labour or human trafficking. The bidder must also have no outstanding taxes or social security contributions, breaches of environmental, social or labour law, bankruptcy, liquidation or other insolvency situation, suspended business activity, serious professional misconduct, anti-competitive agreements, unavoidable conflict of interest or unjustified involvement in preparing the procurement. The notice also covers early termination of previous public contracts or concessions, damages or comparable sanctions, as well as false statements, withholding information, failure to provide required documents or improper influence over the contracting authority’s decision-making. Additional national exclusion grounds concern enabling an unlawfully staying foreign national to work in Estonia, applicable international or national sanctions, and convictions for tax offences. For tax and social security debt, the notice states a threshold of EUR 0; statutory exceptions may apply when a tax authority certificate is issued, for example for debt below EUR 100 or rescheduled debt. Where an exclusion ground exists, evidence of remedial measures may be submitted in certain cases. The bidder must provide the required answers and evidence in the ESPD and verify the details in the tender documents.

Qualification criteria and exclusion grounds

The bidder’s net turnover must have been at least EUR 150,000 in each of the last two financial years completed before the procurement was launched. If the financial year follows the calendar year, turnover data for 2024 and 2025 must be provided. Within the 36 months preceding the launch of the procurement, the bidder must have properly performed at least two contracts for operating paid parking services. Each contract must have covered at least 50 operated parking spaces and lasted continuously for at least 12 months; a contract may still be ongoing if the 12-month duration was completed during the reference period. The ESPD must include the parking facility name and location, number of parking spaces, contracting party’s name and contact details, and contract validity period; for contracts awarded through a public procurement, the procurement reference number must also be provided. Upon request, the bidder must submit confirmation from the client that the contract was properly performed. If the information is not available from public databases without significant cost, any requested clarifications, confirmations, data or documents must be submitted within three working days of the request. The tender must accept all conditions set out in the tender documents, and the bidder must verify the service volumes and include all necessary work in its offer. The bidder must submit the participation application using Form 2 and a list of documents classified as trade secrets with reasons. The financial offer must state the percentage of VAT-exclusive net parking-fee revenue that the concessionaire will pay monthly to the concession grantor for operating the parking service and must follow the prescribed structure. Joint bidders must appoint a representative from among themselves and submit the power of attorney and joint and several liability confirmation under Form 8. The bidder must confirm compliance with the tender documents and, where relevant, provide explanations and evidence of equivalence. The bidder, any joint bidder and any entity whose capacity is relied upon must not be based or domiciled in Russia or Belarus.
