Compliance requirements
The bidder must confirm that neither it nor its representatives or members of its management or supervisory bodies has received a final conviction within the last five years for, among other matters, participation in a criminal organisation, corruption, fraud, terrorism-related offences, money laundering or terrorist financing, or the unlawful use of child labour or other forms of human trafficking. Compliance with tax and social security payment obligations is also checked. For tax debt, the notice states a threshold of EUR 0, although the tax authority does not issue a certificate where the debt is below EUR 100 or payment of the debt has been deferred.
The exclusion grounds also cover breaches of environmental, social and labour-law obligations; bankruptcy, liquidation or another insolvency situation; an agreement with creditors; assets administered by a liquidator or court; suspended business activity; serious professional misconduct; agreements distorting competition; conflicts of interest; prior involvement in preparing the procurement; and serious breaches of previous contracts resulting in early termination, compensation or sanctions. The bidder must also not have submitted false information, failed to provide required information or documents, improperly influenced the contracting authority, or sought confidential information.
The national exclusion grounds additionally address enabling an unlawfully residing foreign national to work, international sanctions, local tax debt in the contracting authority’s country and convictions for tax offences. The bidder must confirm that it will not use a subcontractor who would have to be replaced because of an exclusion ground. First-tier subcontractors are subject to checks, and if the bidder relies on a subcontractor’s resources, a procurement passport must also be submitted for that subcontractor.
Qualification criteria and exclusion grounds
The bidder’s turnover in the field of maintenance, repair and installation of doors and related fittings, including the supply of related spare parts, must have been at least EUR 2,000,000 during the last two completed financial years. The bid must state the relevant period, amount and currency and, where applicable, the details needed to verify the information electronically.
The bidder must have properly performed at least one contract for the provision of door or opening-element maintenance, repair or installation services during the last five years. The submission must include the contract description, total value, the bidder’s area of responsibility, performance period, client and contact-person details, together with the other required evidence.
The bidder must be authorised to maintain and re-key ABLOY key systems and to order additional keys. This must be demonstrated by a confirmation from the manufacturer or its official representative. The bid must be submitted using the prescribed price form in Annex 2, and the price must follow the structure specified in the sheet containing the award criteria and measurable indicators. Conditional bids are not permitted.
The bid must include the name, position and authority basis of the person who would sign the contract; where signing authority is based on a power of attorney, the power of attorney must be attached. It must also include the names, positions, telephone numbers and email addresses of the contact person or persons for contract performance. If subcontracting is used, Annex 4 information must be provided on the subcontractor’s legal representatives, the nature of the subcontracted work and its percentage share. If the bidder relies on another entity’s capabilities, that entity’s consent under Annex 5 must be attached. In a joint bid, a power of attorney from the joint bidders must be submitted.
The bidder must confirm that the goods offered are not subject to international sanctions and do not originate from sanctioned regions. The bidder must also not involve, for more than 10% of the contract value, sanctioned Russian persons or companies, entities owned or controlled by them, or suppliers or subcontractors acting on their instructions.
