Compliance requirements

The bidder must not be subject to exclusion grounds relating to participation in a criminal organisation, corruption, fraud, terrorism-related offences, money laundering or terrorist financing, child labour or human trafficking. The bidder must also have no outstanding tax or social security payment obligations, breaches concerning the employment of persons unlawfully residing in the country, or circumstances where concluding the contract would violate an international or Estonian sanction. The bidder must provide the relevant declarations in the ESPD and, where required, supporting evidence and explanations. If an exclusion ground exists, remedial measures demonstrating restored reliability may in certain cases be submitted where permitted by the procurement or applicable law.

Qualification criteria and exclusion grounds

The bidder’s net turnover must have been at least EUR 100,000 in each of the last three financial years. During the 60 months preceding publication of the contract notice, the bidder must have completed at least two similar construction or renovation works. Each reference work must have had a construction value of at least EUR 60,000 excluding VAT and must have involved construction or renovation works covering at least 150 m². The ESPD must include a list of the contracts, including the contracting partner’s name and contact details, the object, value, contract validity period and, where applicable, the procurement reference number. For performance of the contract, the bidder or consortium must have at least one site manager with higher education in construction and a Level 7 Chartered Construction Engineer qualification or equivalent. The bidder must provide the site manager’s name and qualification details; if the site manager is not an employee or management board member of the bidder, evidence of engagement for the entire contract period must be provided upon first request. The tender must comply with the procurement documents and must not be conditional. The price must be submitted according to the prescribed structure and price table; the sum of the unit prices must correspond to the tender price shown on the evaluation sheet. In a joint tender, a power of attorney for the joint bidders must be included. The bidder must identify and justify any trade secrets; the tender price and figures relating to the award criteria may not be classified as trade secrets.
