Compliance requirements

The bidder and its representatives, members of its management or supervisory bodies, authorised representatives, and other persons with control or decision-making authority must not have been convicted of participation in a criminal organisation, breach of integrity obligations, corruption, fraud, terrorism, money laundering or terrorist financing offences. Such persons must also not have been convicted of enabling the employment of a foreign national staying in the country unlawfully or breaching the conditions of a foreign national's employment, including paying less than the required wage, or of unlawful use of child labour or an offence related to human trafficking. The bidder must not have outstanding state tax, duty or environmental-charge debts, or outstanding tax or social-security contributions under the law of its country of establishment. The contracting authority may also exclude a bidder for a serious or repeated breach of an important term of a previous public contract, or where the bidder has submitted false information concerning its qualification or failed to provide requested information or documents. An undertaking whose place of residence or establishment is in the Russian Federation or Belarus may not participate. Materials, equipment, goods or components originating from or produced in those countries may not be used in the works; the contracting authority may request certificates of origin. The bidder must provide the relevant confirmations.

Qualification criteria and exclusion grounds

During the 60 months preceding the commencement of the procurement, the bidder must have properly completed at least three contracts for electrical construction works similar to the subject matter of the contract. At least one contract must have had a value of at least EUR 40,000 excluding VAT. The bidder must submit a list of the contracts including the performance periods, information about the other contracting parties, the contracting authority's representative's contact details, and reference numbers for public contracts. The contracting authority may request evidence of proper performance. The bidder must have a person with switching authorisations for work-related switching operations in a 0.22–20 kV electricity network, registered in Elektrilevi's partner portal before the tenders are opened. For low-voltage works only, at least low-voltage switching authorisations are required; in other cases, both low- and medium-voltage switching authorisations are required. The bidder must also have a person responsible for the work operation, registered in the same portal before the tenders are opened. The person leading the electrical works must hold a valid A-level competence or a qualification corresponding to at least level 6 under the Estonian Professional Qualifications Act, possess the relevant evidence, and be registered in Elektrilevi's partner portal before the tenders are opened. The tender must include the required previous-contract information form, a completed price table with all unit-price fields filled in, and the name, position and contact details of the contract signatory and contact person. If the signatory's authority does not arise from the articles of association, a power of attorney must be included. The tender must comply with all tender document requirements; additional conditions and conditional tenders are not allowed.
