Ordering lift maintenance services for the buildings of the University of Tartu

The bidder must confirm in the ESPD that neither it nor persons with management, supervisory or representative authority have relevant convictions for participation in a criminal organisation, corruption, fraud, terrorism, money laundering, terrorist financing, unlawful use of child labour or human trafficking. Exclusion grounds also cover tax or social security payment arrears, breaches of environmental, social or labour law, bankruptcy or other insolvency, liquidation, suspended business activity, serious professional misconduct, anti-competitive agreements, conflicts of interest, involvement in preparing the procurement, serious breaches of previous public contracts, and the submission of false information or failure to provide required documents. The requirements also address enabling the unlawful employment of foreign nationals, international sanctions, tax offences and legal restrictions on participation. The bidder must disclose the names and personal identification codes of persons with representative or control powers who are not visible from the relevant register, or confirm that no such persons exist. Where an exclusion ground applies, evidence of remedial measures restoring reliability may be submitted where applicable.

The bidder’s net turnover in each of the last three financial years completed before the start of the procurement must be at least EUR 140,000. If the financial year is the calendar year, turnover data must be provided for 2023, 2024 and 2025. The bidder must also provide at least one contract in the field of lift maintenance and repair that was performed during the 36 months preceding publication of the contract notice with a completed value of at least EUR 40,000 excluding VAT. The submission must include a description of the contract, performance period, value, the bidder’s scope of responsibility, and the client’s name and contact details. For an ongoing or older contract, the value completed during the relevant 36-month period must be stated. At least two employees must be directly involved in contract performance. They must speak Estonian to the extent necessary for performance, or the bidder must provide interpretation at its own expense; each must have at least three years of experience in lift equipment maintenance and repair and must have completed lift maintenance training or hold a relevant professional qualification, competence certificate or equivalent proof of competence. The bid must include a confirmation that personnel meeting these requirements will be engaged. The individuals’ details and competence documents must be submitted no later than before contract signature, although they may also be submitted with the bid. The bid must include the price submission table in the form of Annex 2, a service compliance confirmation and all other required confirmations and documents. If the signatory’s authority is not apparent from the relevant register, a power of attorney in the form of Annex 3 must be provided. For a joint bid, the joint bidders’ power of attorney and joint and several liability confirmation in the form of Annex 4 must be submitted, together with an ESPD for each joint bidder.
