Compliance requirements

The bidder must confirm that none of the exclusion grounds set out in § 95 subsections 1 and 4 of the Public Procurement Act apply to it. The bidder may not use subcontractors or suppliers for more than 10% of the contract value if they are Russian Federation nationals, residents or entities established in the Russian Federation, entities directly or indirectly more than 50% owned by such persons or entities, or their representatives or persons acting on their instructions. The bidder must also confirm that it will not use a subcontractor who would have to be replaced under § 122 subsection 7 of the Public Procurement Act. Goods subject to international sanctions or originating from sanctioned regions may not be offered. Breaches may lead to rejection of the tender or the contract being deemed void.

Qualification criteria and exclusion grounds

The bidder must be registered in the commercial register or another relevant register of its country of establishment and hold all registrations, licences or rights of activity required to perform the works. Its average construction-related net turnover in 2023, 2024 and 2025 must be at least EUR 800,000 per year. If the bidder has operated for fewer than three financial years, compliance will be assessed using the average turnover for the available financial years. Turnover data must be provided by year, and the contracting authority may request additional evidence. During the previous 60 months, the bidder must have properly completed at least two construction contracts as the main contractor. Acceptable references concern the construction, extension or reconstruction of production, warehouse, cold-storage, agricultural or industrial buildings. Each reference must include the client’s name, the name and brief description of the works, the contract performance period, and the client contact person’s details. The bidder must provide a site manager responsible for contract performance who has, during the previous 60 months, managed at least one comparable production, warehouse, agricultural or industrial building construction or reconstruction project. The submission must include the site manager’s name, position, education, professional qualification or other qualification, together with details of the comparable project and the manager’s role. The tender must comply with the tender documents, be unconditional and include the required works-volume table. The price must follow the prescribed structure, and the total in the works-volume table must equal the tender price entered in the procurement register. In a joint tender, a power of attorney appointing an authorised representative must be submitted. Where relevant, explanations and evidence of equivalence must be included, and any trade secrets must be identified and justified.
