Road and street maintenance works in Jõhvi municipality (Jõhvi area)

The bidder must confirm that neither it nor its administrative, management or supervisory bodies or representatives are subject to exclusion grounds. The checks cover, among other matters, final convictions for participation in a criminal organisation, corruption, fraud, terrorism-related offences, money laundering or terrorist financing, and the use of child labour or trafficking in human beings. Compliance with tax and social security payment obligations is also checked; the applicable threshold for tax debt is EUR 0, subject to the statutory exceptions concerning the issue of tax debt certificates. Other exclusion grounds may include breaches of environmental, social or labour-law obligations, bankruptcy or other insolvency, liquidation, assets managed by a liquidator or court, suspended business activities, serious professional misconduct, agreements distorting competition, conflicts of interest, prior involvement in preparing the procurement, material breach or early termination of a previous public contract, submission of false information, failure to provide required information or documents, and improper attempts to obtain confidential information. The checks also cover enabling an illegally staying foreign national to work, international sanctions, and convictions for tax offences. The bidder must provide truthful information and may, where applicable, submit evidence of remedial measures demonstrating restored reliability.

The tender is divided into two lots: Lot 1, the northern area, and Lot 2, the southern area. A bidder may submit a bid for both lots, and contracts may be awarded to one bidder for up to two lots. For either lot, the bidder must have a combined net turnover of at least EUR 1,000,000 during the last three completed financial years, 2023, 2024 and 2025. The bidder must have the technical capacity to perform road and street maintenance and must submit the required confirmation of available equipment using Form 4. The person responsible for the maintenance works must hold a road engineer professional qualification at level 6 or higher, specialising in road construction and maintenance or roads, with competence in construction activity management or maintenance. The responsible person must also have at least three years of experience in year-round maintenance of publicly used roads and, during the 36 months preceding the start of the procurement, must have participated as the responsible person in at least one such maintenance contract with a value of at least EUR 500,000 excluding VAT. The bidder must submit the responsible person’s CV and a signed confirmation that the person will participate directly in contract performance. The bid must include the required cost schedule: Annex 6-1 for Lot 1 and Annex 6-2 for Lot 2. The tender guarantee must be EUR 12,000 and remain valid for the same period as the bid; it must be provided as a guarantee from a credit or financial institution or insurer, or by depositing the money into the contracting authority’s bank account. The bid must comply with all tender document requirements, and conditional bids are not permitted. Where relevant, an explanation and evidence of equivalence must be provided. In the case of a joint bid, a power of attorney for the joint bidders must be attached. The bidder must identify and justify any trade secrets, but the bid price and numerical figures relating to evaluation may not be classified as trade secrets.
