Compliance requirements
The bidder must confirm that neither the bidder nor its management, administrative or supervisory body members or representatives have received a final conviction within the last five years for, among other matters, participation in a criminal organisation, corruption, fraud, terrorism-related offences, money laundering or terrorist financing, illegal use of child labour or human trafficking. The exclusion grounds also cover breaches of environmental, social and labour-law obligations, bankruptcy or insolvency proceedings, liquidation, suspension of business activities, serious professional misconduct, anti-competitive agreements, conflicts of interest, prior involvement in preparing the procurement, and early termination, damages or sanctions resulting from a material breach of a previous public contract. Grounds may also include submitting false information, failing to provide required information or documents, or improperly influencing the contracting authority’s decision-making. The bidder must comply with tax and social security payment requirements; the threshold for tax and social security debt is EUR 0. The bidder must also confirm compliance with national exclusion grounds concerning employment of unlawfully staying foreign nationals, international sanctions and any participation restrictions based on the bidder’s place of residence or establishment. Where an exclusion ground applies, evidence of remedial measures may be submitted in certain circumstances.
Qualification criteria and exclusion grounds
A bidder may submit a tender for no more than one lot. The tender must be unconditional, and alternative solutions are not permitted. The bidder must submit the tender form provided in Annex 2 of the tender documents, the price through the e-procurement price sheet and on the form provided in Annex 3. The tender must describe the educational programme to be created, including its title, content, subject, objectives and venue with address; describe cooperation days and community involvement; explain how the programme will support participants’ learning of Estonian and the expected results; and describe the delivery methods and independent assignments.
The team must include at least two members: a project manager and a programme leader. The project manager must have higher education, native-level Estonian or at least C1 proficiency, and at least 12 months of project management experience during the ten years preceding the commencement of the procurement. The programme leader must have higher or secondary specialised education, native-level Estonian or at least C1 proficiency, and at least 12 months of experience delivering an educational programme or training to an adult group during the same ten-year period. A digitally signed CV in the form provided in Annex 6, together with the required supporting documents, must be submitted for both roles.
If the bidder is not a cultural institution delivering the programme in its own premises and based on its own substantive resources, it must involve a cultural institution as a cooperation partner and submit the partner’s details and the required confirmation letter. If the signatory is not the bidder’s statutory representative, a digitally signed power of attorney must be submitted. In a joint tender, a power of attorney for the joint bidders must be provided. The tender price must include all costs related to creating and delivering the programme, including staff costs, subcontractor fees, worksheets and other learning materials, teaching aids and catering.
