Compliance requirements
The bidder must confirm that neither the bidder nor its representatives or persons with management, control or decision-making powers have been finally convicted during the last five years of participation in a criminal organisation, corruption, fraud, terrorist offences, money laundering or terrorist financing, or unlawful employment of child labour or trafficking in human beings. The exclusion grounds also cover breaches of tax and social security payment obligations, environmental, social and labour law obligations, bankruptcy or other insolvency situations, liquidation, suspended business activity, serious professional misconduct, anti-competitive agreements, conflicts of interest, prior involvement in preparing the procurement procedure, and material or persistent breaches of previous public contracts. The bidder must also not submit false information, omit required information or documents, or improperly influence the contracting authority’s decisions. The notice also addresses breaches related to enabling the employment of unlawfully staying foreign nationals, being subject to an international sanction, owing local taxes imposed in the contracting authority’s location, and tax offences. For tax and social security debt, the notice specifies a threshold of EUR 0; however, the tax authority does not issue a tax-debt certificate for debt below EUR 100 or for rescheduled tax debt. Where applicable, the bidder must describe the circumstances, provide evidence of fulfilled obligations or remedial measures, and disclose authorised persons who are not visible in the relevant business register.
Qualification criteria and exclusion grounds
The bidder must have the equipment necessary to perform the contract or a written arrangement allowing the equipment to be obtained or used. Equipment details must be provided in the ESPD separately for each lot included in the tender: Lot 1 Sindi town area, Lot 2 Tori area, Lot 3 Tammiste area, Lot 4 Kiisa, Vainu, Pulli and Rütavere villages area, Lot 5 Kilksama, Räägu and Urge villages area, Lot 6 Sauga small town, Eametsa and Nurme villages area, Lot 7 Are small town and the specified villages area, and Lot 8 Võlla, Suigu and Murru villages area. Within five days of receiving the contracting authority’s request, the successful bidder must provide copies of the required equipment registration certificates and documents proving the right to use equipment not owned by the bidder, such as a subcontracting agreement or preliminary agreement. The tender must confirm acceptance of all tender-document conditions; conditional tenders are not permitted. The tender price must be submitted in the structure specified by the contracting authority. In a joint tender, a power of attorney from the joint tenderers must be included. The bidder must identify any trade secrets and provide reasons, but may not classify the tender price or numerical figures corresponding to the award criteria as trade secrets. If an equivalent solution is used, the equivalence must be explained and supporting evidence submitted. The machine-readable notice does not provide a precise equipment list or other detailed technical parameters; these must be checked in the tender documents and the technical specification.
