Compliance requirements
The bidder must confirm that neither the bidder nor members of its representative, management or supervisory bodies have been finally convicted during the last five years of participation in a criminal organisation, corruption, fraud, terrorism-related offences, money laundering or terrorist financing, or the use of child labour or other forms of human trafficking. The bidder must also not have breached its tax or social security payment obligations, seriously breached previous public contracts, enabled the employment of a foreign national without a legal basis, or be subject to an international sanctions-related exclusion ground. Participation by companies established or domiciled in Russia or Belarus is not permitted. Where an exclusion ground applies, evidence of measures restoring the bidder’s reliability may be submitted in applicable cases. First-tier subcontractors will be checked during contract performance; they are not required to submit a separate ESPD.
Qualification criteria and exclusion grounds
The bidder’s average annual turnover for the period 1 January 2023 to 31 December 2025 must be at least EUR 130,000. During the 60 months preceding publication of the tender, the bidder must have completed at least two contracts involving the full construction or reconstruction of a municipal wastewater treatment plant with a pollution load of at least 250 population equivalent units and a SCADA remote monitoring and control system. This requirement may also be met through one contract. If a SCADA solution was not installed in the relevant wastewater treatment plant works, competence in SCADA installation must be demonstrated through a separate reference project for another municipal wastewater treatment plant where the bidder did not perform other construction or reconstruction works.
The team must include the following key personnel: a project manager and a site manager who are at least level 6 water supply and sewerage engineers, specialised in external water supply and sewerage and construction activity management; a design team manager who is at least a level 7 qualified water supply and sewerage engineer, specialised in design management; and an electrical and automation specialist holding electrical works competence class B or an equivalent qualification. The project manager and site manager roles may be performed by the same person if that person meets both sets of requirements.
The bidder, a member of a joint tender, or the relevant subcontractor must be registered in the Estonian Register of Economic Activities or an equivalent professional register in its country of establishment for municipal water supply and sewerage construction, including pumping stations and treatment plants, road construction, and the design and construction, including installation, of electrical installations. A foreign company must submit evidence of registration in the relevant professional register. The tender must include the team form, confirmation of registrations, the completed unit-price table and tender form, and, where applicable, the key person’s employer confirmation, subcontractor details and a signing authorisation. If subcontractors are used, all subcontractors directly involved in contract performance and their written consents must be identified. The tender must comply with the procurement documents; where equivalence is offered, the equivalence and supporting evidence must be explained in the tender.
