Compliance requirements

The bidder must confirm that neither it nor members of its representative, management or supervisory bodies are subject to the exclusion grounds set out in Section 95(1) of the Estonian Public Procurement Act. These include, among other matters, convictions for participation in a criminal organisation, corruption, fraud, terrorism, money laundering, facilitating unlawful employment, unlawful child labour or human trafficking, as well as tax or social-security debts and risks related to sanctions violations. The contracting authority may also exclude a bidder for breaches of environmental, social or labour-law obligations, bankruptcy or liquidation, serious professional misconduct, anti-competitive conduct, an unresolved conflict of interest, a material breach of a previous public contract, false or misleading information, a tax offence, or lack of the right to submit a tender. A tender may not be submitted by an undertaking or association whose registered office or residence is in Russia or Belarus. The bidder must provide the relevant confirmations and, where necessary, details enabling the information to be verified electronically.

Qualification criteria and exclusion grounds

The bidder’s net turnover from selling similar small IT equipment must have been at least EUR 150,000 in each of the last three completed financial years. The bidder must submit the turnover data in a document prepared in free form. The bidder must have at least three years of experience selling the products offered. During the last three years, it must have properly performed at least three contracts involving goods similar to those offered in this tender. For each contract, the bidder must provide the contracting customer, the contact person’s name and contact details, a description of the contract subject, and the performance period. The tender must include a product catalogue with prices for a sample shopping basket, the public web address of the online ordering environment, access details for a demonstration account with all required features, and a sales-support telephone number. The bidder must submit the price form in Annex 2. The tender must comply with all tender-document requirements and must be unconditional. If an equivalent product, standard, label or other solution is offered, the bidder must explain its equivalence and provide supporting evidence. The tender must be submitted by the bidder’s statutory or authorised representative; where necessary, a power of attorney or other proof of authority must be included. In a joint tender, a power of attorney from the joint bidders must be submitted. Any trade secret must be described and its designation justified, but the tender price and item prices may not be classified as trade secrets.
