Compliance requirements
The bidder must confirm that neither it nor its representatives, managers or supervisory body members have received a final conviction within the last five years for participation in a criminal organisation, corruption, fraud, terrorism, money laundering, terrorist financing, or offences involving child labour or human trafficking. Exclusion may also result from tax or social security debt, breaches of environmental, social or labour law, bankruptcy or other insolvency, liquidation, suspended business activity, serious professional misconduct, anti-competitive agreements, an unresolved conflict of interest, or a material breach of a previous public contract. The bidder must also confirm that it has not submitted false information, failed to provide required information or documents, sought confidential information, or improperly influenced the contracting authority’s decisions. The checks also cover violations involving the employment of unlawfully staying foreign nationals, international sanctions, tax offences and restrictions on the right to participate in the procurement. Where an exclusion ground exists, the bidder may in certain cases provide evidence of remedial measures restoring its reliability. The required responses and, where applicable, evidence must be provided in the ESPD.
Qualification criteria and exclusion grounds
The bidder must be registered in the Estonian commercial register; a foreign bidder must be registered in the required register in its country of establishment and provide registration evidence where required. The bidder’s average annual net turnover for the last three financial years completed before the start of the procurement, 1 January 2023 to 31 December 2025, must be at least EUR 130,000. For a business operating for less than three years, the average is calculated over its actual operating period. Joint bidders may combine their turnover figures. During the 60 months preceding the start of the procurement, the bidder must have properly completed at least two similar construction contracts. A similar contract means the construction or reconstruction of a publicly accessible asphalt-surfaced pump track with at least 350 m² of asphalt riding surface; the two references may together have a total riding surface of at least 700 m². A contract is considered completed once the works have been carried out and the site has been accepted by the client. The bidder must provide the reference details and, upon request, confirmation from the client that the works were properly completed. The contract must be performed with a project manager holding at least a level 6 road engineer qualification with the relevant road and construction management competence, or a level 6 construction manager qualification in general construction, or an equivalent EQF level 6 qualification. The project manager must participate personally and directly in contract performance, and any replacement requires the contracting authority’s prior approval. If the bidder relies on another entity’s capacities, or if the project manager works under a contract for services, the bidder must also submit that person’s or entity’s ESPD and consent to the reliance. The required evidence and declarations must be submitted in accordance with the tender documents.
