Compliance requirements
The bidder must not be subject to exclusion grounds, including a final conviction within the last five years, or a still-effective exclusion obligation, for participation in a criminal organisation, corruption, fraud, terrorism-related offences, money laundering or terrorist financing, illegal use of child labour or human trafficking. The bidder must also have fulfilled its tax and social security payment obligations and must not breach requirements concerning the employment of unlawfully staying foreign nationals or international sanctions. Where applicable, the bidder must provide explanations and evidence; in certain cases, it may also describe measures taken to restore its reliability. The bid must confirm that prohibited subcontractors or suppliers will not be used during contract performance, including sanctions-related persons whose share would exceed 10% of the contract value.
Qualification criteria and exclusion grounds
The bidder’s average annual turnover for the period 1 January 2023 to 31 December 2025 must be at least EUR 400,000. Within the 60 months preceding the start of the procurement, the bidder must have properly completed at least one construction contract involving the construction or reconstruction of a total of at least 1,000 metres of public drinking-water pipeline. The ESPD must include the contract description, performance period, contracting authority and contact-person details and, where applicable, the procurement reference number; the contracting authority may verify the experience with the client or request additional confirmation. The bidder must provide a site manager with at least the qualification of level 6 construction site manager – water supply and sewerage engineer, specialising in external water supply and sewerage, with competence in managing construction activities. The bid must include Form 1, the bid form, and Form 4 concerning the bidder’s team; where applicable, Form 2 for a joint bid, Form 3 confirming the key person’s employer consent, and Form 6 authorising submission of the bid must also be provided. If subcontractors are used, Form 5 must identify all known subcontractors, the work they will perform and their percentage share; a relied-upon entity must submit a separate ESPD and evidence that its resources are available. The bid must comply with the tender documents, the price must follow the required structure, and any equivalent solution must be explained and supported by evidence.
